The article points to a section of the b12 bylaws that allow kicking out for lack of institutional control, and something about prompt effective action. While there was a failure by Baylor in the past (so, not quite prompt action), it wouldn't be hard to argue that prompt and presumably effective action was taken after the PH report. Briles was fired, Starr was ousted, AD is gone. All the rape allegations that continue to come out are from past incidents from when those guys were in charge. Point being, at this point Baylor is at least making it look like it is taking prompt and effective action once the issues came to light. With the withhold 25% until you demonstrate change, I think the ship has sailed on kicking Baylor out.
As for using a finding of lack of institutional control by the NCAA to kick them out, what an interesting precedent to set. Can't imagine anyone would want to make a permanent home in a place where NCAA punishment is also met with being kicked out of the conference.
And what about the B12? Pretty sure there media contracts all required at least 10 teams. That is why the scramble to add TCU and WV when we left. After going through the charade of considering expansion last year, they are still in a place where loss of 1 team would be a problem. And the GOR won't save them. Kicking Baylor out would mean Baylor gets its rights back (whatever that is worth).
