If you ask Seattle Seahawks fans how their team made it to the Super Bowl, they would no doubt point to the power of "the 12th man," as the raucous fan base is known. According to Aggie lore, it all started in a January 1922 game in which the coach found himself short on players in a big game and ended up recruiting a student named E. King Gill from the stands. Gill suited up and stood by the sidelines, the story goes. Though he never played, his willingness to support his team made him a legendary figure at A&M. A statue of Gill was erected outside of the football stadium, and fans stand throughout home games in his honor.

A&M's claim to the trademark on "the 12th man" rests on the legendary 1922 game giving birth to the expression. But in recent years a University of Texas alumnus who writes under the pen name Randolph Duke has been poking holes in the story. He uncovered a 1912 article in The Iowa Alumnus in which "the loyal spirited Iowa rooter" is called "the 12th man on the team." And even earlier than that, in 1900, a magazine from the University of Minnesotareferred to "the mysterious influence of the 12th man on the team, the rooter."

Referring to impassioned fans as "the 12th man" took hold in football-crazy Texas in the 1920s, and not just at A&M. The earliest example from A&M comes from a November 1921 issue of the college newspaper The Battalion. The timing is a bit troublesome for the Aggies' accepted version of events, as it was a few months before the game that supposedly started it all.

Adding to the historical murk, there are no known contemporary accounts of Gill's role in the 1922 game—recollections from Gill and others were gathered decades later. Gill himself said the "12th man" legend originated in a 1939 radio play.

Despite the recent evidence, Shane Hinckley, A&M's interim vice president of marketing and communications, stands by the trademark claim. "We have the longest continued use of the 12th Man mark, dating back to 1922," he said.

Just like the ****s said I was all wrong when I shot holes in their beloved 12th Man story, I am sure they will cry, complain, squeeze their nuts and deny they are still legally a branch of UT. They legally still are. Maybe we can also get the constitutional amendment story in the WSJ.


Hey dip****. I know you read this forum. I'll bet you 5,000 dollars this amendment never happens. For what should be obvious reason for anyone who didn't spend their child hood sniffing glue. There is absolutely no way either institution is going to open up the PUF to be raided by the other state schools, which is exactly what would be the fallout of this.

But, I truly urge you to try. Your insane antics are just about the most entertaining thing on the interwebs.

This is still good press. As long as Aggie Traditions are in the news during Super Bowl week, we should be happy.

Randolph can scream about A&M some more. But he can't change the fact that E King Gill and the 12th man tradition was a real event in A&Ms history.

This is funny as hell. It doesn't matter if someone said "12th Man" at some point before E King Gill volunteered. Why does he think that matters? A&M decided to trademark it first. Don't you think someone said "just do it " at some point before Nike?

Why do peoples seem to gloss over the fact that the 12th man means something different when a person comes out of the stands?

Nobody refutes that E. King Gill came from the stands to the sideline. The 12th man became something different that day.

Any reasonable attorney is going to point out even today they are claiming it started in 1922 (something even the Wall Street Journal isn't accepting). A representative from tamu will be put under oath and asked if the university's embrace of the phrase did or did not begin in 1922. They will have to say it started in 1922 because that is what they attested to under penalty of perjury to in their filings. The next question will be how the school's embrace of the phrase at least as early as 1921 differed from their claims in the trademark filing they first embraced the phrase in 1922. Game over. The school will not admit under oath they didn't have a clue as to the true nature of their most sacred tradition. They will never defend their trademark against anyone wanting to challenge it in court.

If they had filed true and accurate trademark filings with the government saying their first use was 1921 (or whenever) and their first use in commerce as 1939 (the radio play) they would have argument, but to claim to be a school that is infused with its history and traditions and then have to state under oath they really don't understand their history or traditions is something the ags simply will not do.

This guy has never, never argued in court. That argument would not stand. One mention in the battalion is not embracing the term by the university. The story of Gill coming out of the stands hasn't changed.
It doesn't matter if somebody said it first. It's not copyright. When we filed for the trademark, the Seahawks had already been using it. It didn't matter. We've owned it and protected it for 25 years now.
