I am a tenant with an unbelievable landlord that refuses to make repairs. Previously, a storm damaged trees at the property and he insisted it was my responsibility to have the trees cut down and removed.
Now, the freeze last week caused damage to the outside pvc water main pipe. The pipe froze and cracked and we had no water for three days. Landlord says pipes are my responsibility and refuses to get repaired.
I want to be fair, but he is completely unreasonable.
I feel this will be continual problems…..

You need to check the lease terms to see how to terminate (when and where you give notice) and what the ramifications are. Normally there is some fixed charge, plus rent for the remainder of the lease (until filled by a new tenant) and reasonable costs to the Landlord for marketing the property.

Things like a water lines are normally LL obligations, so you may have a claim for breach. You also have rights under the Texas Property Code (Ch. 92) that may offer you relief and may be worth having an attorney look at.

As a landlord, both of those items I would have taken care of. Legally, I'm not sure about the tree, but the plumbing would definitely be a owner repair cost.

Have you looked at your lease for sections regarding repairs; default; remedies, etc.? Always be current on your lease payments if a lease dispute arises.

Also look at Section 92.056 of the Texas Property Code.

Unfortunately, it will take several weeks to force the landlord to either fulfill his obligations or you can terminate the lease. Google 92.056 property code. This is the steps you must take to legally either fix it yourself and without rent in the same amount or terminate your lease. It's not quick. Essentially if he doesn't fix it and it affects your health and safety, after 7 days you can send a certified letter giving him another 7 days. And then you can either fix it and deduct from rent or terminate lease.
