This isn't a legal opinion or anything, but just to give people some general info. MM is not on a contract, like Fran. MM is an at-will employee (as far as I know). It's much easier to get rid of an at-will employee than a contract employee. You can get rid of an at-will employee for any reason, or no reason, as long as it is not a legally impermissible reason or is not a pretense for a legally impermissible reason. That's why MM is gone now, because they can.

The details surrounding Fran's contract will take a whole lot more time and legal wrangling to sort out.

Nate, you are proud of our holiday bowl performance? Or our Miami performance? Or the fact that Fresno State should be an 'L'? We are 5-1 because we got the easy part out of the way. If you can't see that then I applaud your ability to keep drinking that koolade without getting a hangover.

Even if the NCAA violations are minor, the NCAA violations are directly attributable to the head coach... don't see how the head coach can retain his job regardless of results on the field.

Nate, you mean being crushed by the two decent teams in the Holiday Bowl and vs. Miami both on NAtional TV and sqeaking by FSU and beating 4 other bad to average teams. I wish people would quit trying to play the 5-1 and 14-5 card. We beat Texas last year, otherwise its been the weak sisters and mid-major scrubs making up the W's. We are one hell of a CUSA team right now, but still 3rd or 4th fiddle in the Big12 South...

Only the South Carolina coach (Spurrier) has been there shorter than Fran at A&M. All the others you mention have had more time than Fran to build their programs. Bad comparison.

Holiday Bowl- Blown out. I don't take that as a good thing
5-1: 0 wins over a top 60 opponent, barely squeaking by much lesser opponents AT HOME, and yet another blowout on national TV.

It was a measured tempured response much like you would expect from BB.The fact we are self reporting violations means Fran voided his contract and blew his golden parachute.He can be let go now just like your football/BB season tickets can be rescinded if you are found in violation of NCAA rules.The fact it isn't happening now is a reflection of the process.Discovery/internal investigation/self reporting then await NCAA response.I see it as a signed death warrant and we are just awaiting the condemmed's appeal/due process.

Assuming Fran didn't know everything being written in these newsletters, which he most likely did, he still allowed someone to write a newsletter using his name. In my working experience, heads roll from the bottom up when things go amiss... he was just as responsible as MM for the newsletters, even if he didn't know every detail of what was written. He's gone at the end of the season.

Come on, guys. What part of this do you not understand? Fran is history on Nov. 24. No way you fire the "mouth" and not the "brain." He could win out, go to a BCS bowl and still be fired.

BB came as close as possible to announcing this without actually doing it. I feel certain that Dennis knows it. Last week Randy Galloway said something to the effect that "anytime a coach starts invoking the name of the Lord, he knows he is fired."

Should have been in the big 12 championship last year if fran didnt screw up the OU game.....i give tech credit for making a great play at the end and winning the game but we should have beat nebraska.....embarassing loss in holiday bowl

This year we have beat no one and got humiliated on national tv by a par team. Should have lost to Fresno and won the OSU game partly bc of a roughing the kicker penalty

Folks, Byrne states that he handles issues with coaches after the season. I'm not sure why that's so hard for some of you to comprehend. He's probably got his coming, so just relax. Getting your panties in a wad because MM got fired and Fran didn't is silly. Byrne will handle this -- calm down.

So who here really believes BB didn't know about this prior to the revelation? Isn't MM an assistant AD?

The decision on the head coach should not be made until the season plays out. I cannot see the benefit to making such a decision today.

The benefit of firing the coach now is that the integrity of the school is more important that one football season.

Keep in mind the investigation is still ongoing. So they may not just be waiting for the season to end, but they may be finishing the investigation so BB can see if theres any more reasons out there to lower Frans buyout.

IMO, let them finish the investigation (and if that happens to finish around T+2, then its fine with me)

sorry, I went to lift before class. Don't take my comments to think i'm just ignorantly and blindly following anything A&M has going on. I send and receive text messages almost weekly during games saying we F'ing suck. I'm not at all content with where we are. I just know that talking percentages, if we were to get a new coach after this season, it would be a big step back. I blame Miami on the players, there was no call Fran could make on offense that would've worked (except maybe JJ to avoid that rush) because our offensive line didn't realize that being all big XII meant still playing your tail off to succeed. They figured it out Saturday and I see us winning 2 of 3 vs. tceh, nebr, ku. couple that with one upset of ou, tu, or mizzou and do you really think it's a good idea to fire fran and chance starting back at square one? It's obvious to me that firing gundy, brown, morriss, etc would be a huge mistake even though a portion of their fans are begging for it. it's harder to see when it's the coach of your own team but, the only reason i see to fire fran is that if next year is not an improvement, it will be much harder to get out of his contract after keeping him for 1 more season after having all the ammo against him. if we lose by 21+ against tceh, I agree, send him on his way and put all that $ under the matress and see who comes calling. (apparently i'm the idiot on here today...kinda sucks)
