Don't know, don't particularly care. I thought that was a b.s. lawsuit too on A&M's part. Maybe the athletic department was seeking to protect dumb Aggies who confused seahawk blue and NFL with Texas A&M and maroon and white.

Based on my experience I can say with a fair amount of certainty that there is an inverse relationship between age and the display of the saw'em off decals. A few exceptions here and there but by and large that is the way it runs.

You don't see many former students with the saw'em off decals and the older they get the less likely they are to have one.
Why? Because they are older and wiser.

Most of the saw'em off decals are displayed by students.
Why? Because they are young and stupid.

That kind of display of obsessive hatred is generally held for some entity viewed as superior by those who see themselves as inferior.

People hate the New York Yankees.
Why? Because they are the best team in the history of baseball.

People hate Notre Dame.
Why? Because historically they are viewed as the premier college football program.

When you display that saw 'em off decal you are placing the sips above yourself and Texas A&M. Whether you see it that way or not is irrelevant because that is the way a lot of other Ags, the sips, and the rest of the world with no affiliation to either school view it. That is the statement you are making to the vast majority of those who see your saw'em off decal regardless of whatever good intentions you may have.

Quite frankly that decal makes you a laughingstock to most. Most of the sips I know love them. It feeds their egos and their arrogant sense of superiority.

Reville (sp?) is not a copyrighted logo of Texas A&M. Therefore it has no legal weight.

Horns are not suing for the right to say this, but the right to use the logo of the longhorn, whiched is unchanged on the A&M shirts except for the sawed off horns.

I can relate to this comment too. I am a graduate and only a 'former student' sticker is on my car though my younger sister who did not even go to A&M has a 'saw'em off' sticker on her car(i'm so proud). I understand why those that don't display a 'saw'em off' sticker don't, however I feel it's stupid to jaw at those who do when it's in our Aggie War Hymn and is sung about 50 times a game (not the song but the actual phrase over and over )

It's not a "fight song." It is our War Hymn.

The War Hymn is what it is. It is a tradition and it is not going to change nor would I want it to. Sawing varsity's horns off is a portion of the War Hymn but not its entirety. The War Hymn is performed in the appropriate venue of Aggie sporting events.

The War Hymn but more prcisely that portion of the War Hymn is not the back of your car displayed 24/7 all over the country wherever you may go. The War Hymn was not written to have a portion of it comercilized for that purpose. The War Hymn was written to be performed at Aggie sporting events.

Put an A&M decal on your car and display pride in Texas A&M not obsession with tu.

i've been told that inspirations is selling shirts at the mall supporting the logo and saying something to the effect of BTHO t.u. and its lawyers. money will go to outfitters to help pay for lawyers

Everytime I see one, I know they can't have graduated from a higher place of education. Kind of embarassing.

I don't much care for all the "Saw 'Em Off" stickers and what not...I have two stickers on the back of my truck, a Texas A&M Engineering Sticker and Corps Stack Sticker...

But I really think that bashing those who do like the sticker and the shirts is really not called for...remember, they ARE Aggies, just like you and me, you don't have to agree with them...Still HATE the sips, but stick behind your family...

Ummm...Last time I checked we did live a capitalist society...

I see nothing wrong with the guy making money off the shirts, because PEOPLE BUY THEM!!!! Besides, it is not like Aggieland Outfitters only sells Saw Em Off Shirts and stickers...

Wouldn't matter so much to me other than the fact that they have been selling them for 10 years and nothing had ever been said...you know, its not like B/CS and Austin are seperated by two time zones or anything...

Note that a trademark is different than a copyright and he was not able to trademark it.

The trademark was applied for in 2002 and abandoned in 2004, likely because there was indeed a complaint.

But his company applied for another "saw em off" trademark in 2003. This for:

This apparently slipped through the cracks when it was published for opposition as it was officially approved by the trademark office on November 28, 2006.

That's four days after Texas played A&m on the 24th. So the lawsuit likely had nothing to do with the game.

It looks to me that AO will take a hit on this. The court documents filed by The t.u. Board of Regents (not some lose cannon texas-ex) state that AO was denied a copyright from the copyright office because the sticker mutilated a pre-existing copyright...AND the copyright office also said...get this...

"The nature of a rivalry is to disparage the rival"

So since the AO symbol too closely resembles the t-sip longhorn, but in a disparaging manner, the copyright examining attorney refused registration on the grounds that they cannot grant registration to a mark that disparages an institution.


BUT LOW AND BEHOLD, AO found a new design that the t-sips are okay with because it is not so easily confused with their own.

I don't know how to paste it here. I like it better.

It's funny how one simply assumes that because students are the primary displayers of the "Saw 'Em Off" logo, that makes them stupid, in fact, too stupid to realize this so the "older and wiser" person has to point it out to them...

I completely understand both sides of this argument, and sympathize with both; but lets stop knocking on those fellow ags that have a "Saw 'em off" sticker. I don't personally have one, or any shirts with that on it, but the people who do are displaying school spirit in their own way, and shouldn't ragged on by their fellow ags. While I do agree that there are better ways to show school spirit, I also am not going to attack a fellow ag just because they choose to advertise their need to BTHOtu!

When you sue someone over a simple saying/slogan, be prepared to have other ridiculous lawsuits thrown at you as well. UT will win this lawsuit or an out of court settlement will be reached, simply because of their ties with Austin lawmakers. Also, when a state-run institution is involved, such as UT, it is rarely ever defeated in court.

I don't have time to research this right now, but for all you "legal observers" Isin't there a tort called Trademark Desecration?

And for the real legal observers...Do we have a Case Number for this pleading? I would like to read the thing for myself.

Think a little outside the box instead of being a whiney fanboy. Just the lawsuit alone will likely force AO to drop the shirts altogether based on a cost analysis viewpoint, and this is something UT's athletic department knows well. Receiving a royalty on these shirts MAY be an outcome, but I don't think it is the likely one.

UT won't recieve a lot in way of damages from AO because of the length of time they took filing suit. The most likely conclusion will be that AO will had to modify their logo slightly. As it is right now, the new logo is EXACTLY like the original, sans detached horns.
