TLDR: College Station Hyundai TX USED ILLEGAL BAIT-AND-SWITCH TACTICS, LEAVING MY SIGNIFICANT OTHER AND I WITH OVER $300 IN RENTAL CAR BILLS! THEY OFFERED NO HELP WHATSOEVER WITH THIS SITUATION OR ANY COMPENSATION AFTER WHAT WE WENT THROUGH. BUYERS BEWARE OF THESE SCUMMY DEALERSHIP PRACTICES.

My significant other and I were involved in a car accident about three weeks ago, which left our car totaled. As a result of the car accident, we had actively been searching for a new car and found a 2023 Hyundai Tucson SEL that we wanted to purchase at College Station Hyundai in Texas. On the evening of 1/6/23, my significant other and I called College Station Hyundai to inform them of our interest in purchasing the car and to ask if the car was still available. Our salesperson at College Station Hyundai , John Gaston, informed us that evening that the car was still available and ready to be sold. We informed John Gaston of our difficult situation, specifically being that our car had been totaled, and let him know that in order to purchase the car we would need to pay for a rental car the morning of 1/7/23 and drive two hours from Austin, Texas to College Station Hyundai. We let John know that getting a rental car was a large expense, and that we did NOT want to come into the dealership unless they could guarantee that we would be sold the car. John spoke with his sales manager, Shaun, and they both guaranteed that the car would be sold to us when we arrived to our 12:00PM appointment on 1/7/23, and not to somebody else. Shaun then sent us an itemized contract for us to look over and instructed us to email it back with writing about our negotiated price. The salesperson instructed us to not sign the document, as the contract listed the MSRP price and not the final, negotiated price. We sent back the contract to John as directed with our written negotiated price at the bottom. John then instructed us to fill out a credit application on the Hyundai website for the car and go to the bank to take out a Cashier's Check with College Station Hyundai's name on it to secure the car, all of which we completed. After John received all of these documents (both the credit application and the contract), he gave us a call informing us that everything was good to go and the car would be sold to us when we arrived tomorrow. They also let us know we couldn't put a deposit down for the car online, and would need to come in person. The sales manager, Shaun, at College Station Hyundai then proceeded to give us a call to inform us (once again) that everything was in place and that the car would be sold to us tomorrow at our 12:00PM appointment on 1/7/22.

On the morning of 1/7/22, we called College Station Hyundai to confirm the details of the car purchase and to make sure that they still hadn't sold it to someone else. Our salesperson, John, let us know that the car was still being held for us, as we had reached a sales agreement and filled out a credit application the night before, and instructed us to go ahead and get a rental car to make the drive down to their dealership. We spent ~$100 on this car rental and promptly headed over to the town of College Station, Texas. Upon arriving to College Station, Texas, we returned the rental car to its drop-off location and hopped into an Uber to make our way down to College Station Hyundai. During this Uber ride, College Station Hyundai called us to once again to confirm that we were still going to make it to our 12:00pm appointment, which we enthusiastically confirm. We then arrive to the dealership for our 12:00pm appointment and meet with John, our salesperson, who proceeds to show us around the exterior of car. He then leaves to grab the right paperwork for the car, but when he comes back he informs us that the dealership actually decided to sell the car a few minutes before to someone else that was willing to pay a higher price. He then proceeds to try and upsell us a car that was roughly $40,000, which completely leaves us baffled. The salesperson lets us know that there is nothing he can do at that point and that even though he had us fill out a credit application and pay for a rental car to drive out to the dealership, he could now only sell us a completely different and more expensive car. The salesperson used illegal bait-and-switch tactics to have us come into the dealership, which ended up costing us over $200 in rental car fees. Since we had already returned our first rental car before arriving to the dealership, we had to either (1) go ahead and purchase the more expensive car or (2) pay for a SECOND rental car to head back home. Knowing we had been completely bait-and-switched, we turned down the more expensive car and left the dealership as they refused to provide us with any compensation for having deceived us into paying for a rental car to make the trip out to the dealership. Both the salesman and sales manager completely deceived us both the night before and the morning of our 12:00pm car appointment, which ended up costing us over $300 in car rental bills. As a result of the dealerships using ILLEGAL bait-and-switch tactics, we spent MORE than $300 in rental cars and completed a credit application (which left us a hard pull on our credit report) for a car that would NOT be sold to us. THEY USED ILLEGAL BAIT-AND-SWITCH TACTICS TO LURE US INTO THE DEALERSHIP, ONLY TO TRY AND UPSELL US A CAR FOR $40,000. TAKE YOUR BUSINESS ELSEWHERE.

This is why this board recommends never shopping with a Keating Auto Group dealer. They have a long history of shady dealer practices.

This whole situation has been a nightmare. It's a classic Bait-And-Switch situation, where the dealer waits to tell a customer they sold their original car until they've arrived to the dealership, and then tries to upsell them a more expensive car.

I've filed various complaints with multiple Texas consumer protection agencies, so waiting to hear back on those as well!!

My hope it to spread the message about the illegal Bait-And-Switch tactics that dealers are still ******* using.

It just takes one V for Vendetta customer to get things changed (assuming the details pan out here). Disturbing to see Flatout's bad*** car collection and then see a situation like this. Hope he makes it right and changes stuff permanently. I wonder if dealerships simply placate people who call them out like this and then just keep on doing shady **** to everyone else who wouldn't call them on it. Who am I kidding, of course they do :/

It's a tough situation. Under my previous handle, I made a similar post and ended up suing Beck & Masten for pretty much the same set of facts. The difference though is damages. The unit I was going to buy was offered for like $10k under MSRP. We ended up having to buy one at MSRP which made our damages model the difference between the two units, times three for punitive damages allowed under the Texas Deceptive Trade Practices Act, plus attorneys fees, costs, etc. We settled for a VERY good amount…

I was working with ReopAg, our Brenham Hyundai hookup. My car died two weeks before my Tuscon SEL was scheduled to arrive so I purchased one off the lot From NW Hyundai in Houston which is another Keating dealership.

We negotiated a deal close to what RepoAg and I agreed to (once you consider a 1 week rental until the Tucson arrived). The NW Hyundai finance guy tried to switch out the financing deal we had negotiated.

Luckily I was already aware that all Keating Auto Group dealers are crooks so I had a calculator with me to double check their loan amortization.

Did I mention that Keating Auto Group dealers are crooks? Sorry just trying to help the Google algorithms by repeating that Keating Auto Group dealers are crooks.

Last time we really hammered that Keating Auto Group dealers were crooks, they removed the KAG links from their dealer web pages.

Wow… we did not end up buying the car that they offered at ~$40,000 because it was just COMPLETELY ABSURD. It was completely Absurd to go from $33.5k to $40k. We asked them to price match the more expensive car to the price of the original one, since it was THEIR FAULT, and they told us to basically ***** off.

It's a shame I found out the hard way . I can't believe this type of practice is still allowed in today's day and age. I'm continuing to post this story everywhere I can so that others in the area know that the dealership practices illegal bait-and-switching. THIS SHOULD HAPPEN TO NO ONE.

Yeah, based on previous scenarios, I assume Flatout gets this guy his $300. But there are clearly some fundamental integrity issues at that dealership where it's been decided that putting out the occasional pissed off customer fire with a few bucks and saying the right things is preferable to fixing the dealership culture/integrity problem

Honestly I would be surprised if he FLATOUT went out of his way to refund us the fees for our two rental cars. The way the sales managers both SHAUN AND JOHN treated us yesterday was AWFUL. My significant other was the one who went to the dealership in person, and so when he told me about the incident that had just occurred, I immediately asked him to put me on the phone with SHAUN. As you can imagine, I WAS IN EXTREME DISTRESS because my significant other had ALREADY RETURNED his first rental car and WAS NOW BASICALLY STRANDED AT THE DEALERSHIP. While I was on the phone with SHAUN, I EXPLAINED HOW HE LITERALLY F*CKED US OVER, and as soon I said that, SHAUN replied with "I'm not going to tolerate this disrespect" and hung up. I'm sorry, but HOW WAS ME SAYING THAT THEY F*CKED US OVER DISRESPECT??? I was CRYING over the phone and in COMPLETE DISTRESS about what had just happened. OF COURSE IM GOING TO BE UPSET, because they literally f*CKED us over! HOW WAS ANY OF WHAT I SAID DISRESPECTFUL, WHEN IT QUITE CLEARLY WAS A F*CKED UP SITUATION THEY PUT US IN??

BOTH SHAUN AND JOHN HAD MULTIPLE OPPORTUNITIES ON 1/6/23 and 1/7/23 to tell us that the dealership was ACTUALLY FIRST-COME FIRST-SERVE. BUT THESE IDIOTS DID NOT SAY A WORD ABOUT THIS. MY SIGNIFICANT OTHER WOULD HAVE NEVER GOTTEN A RENTAL CAR AND MADE MY HIS WAY OUT THERE IF HE KNEW COLLEGE STATION HYUNDAI WAS FIRST-COME FIRST-SERVE DEALERSHIP. HE KNEW HOW EXPENSIVE RENTAL CARS WERE AND EXPRESSED THIS CONCERN TO BOTH SHAUN AND JOHN MULTIPLE TIMES THROUGHOUT THE NEGOTIATION PROCESS. HE LET THEM KNOW (MULTIPLE TIMES!) HE DIDN'T WANT TO COME INTO THE DEALERSHIP IF THEY COULDN'T GUARANTEE HIM THE CAR. Both SHAUN and JOHN kept assuring him that the car was going to be 100% held for him until he arrived. WE even called the dealer RIGHT BEFORE we got the rental car to make sure everything was in order! They then called us 15 minutes before our 12:00pm appointment to confirm that everything was in order for us to purchase the car! THE DEALERSHIP MADE ALL OF THESE PROMISES, KNOWING ABOUT our rental car situation, and yet had THE AUDACITY TO GET MAD AT US FOR BEING UPSET THAT THEY SOLD THE CAR TO SOMEONE ELSE?? I NEVER would have imagined in my life that a dealership would go THIS FAR to *****over their customers.

Put simply, COLLEGE STATION HYUNDAI NEEDS TO BE HELD ACCOUNTABLE FOR THIS NIGHTMARE OF A SITUATION THEY PUT US THROUGH.

I'm putting in pictures of the rental cars we had to pay for in this thread so that FLATOUT can see how this situation F*CKED us over. These are ONLY the rental car fees and NOT the UBER FEES WE PAID TO travel to and from the dealership from the rental car agencies.

I understand that DEALERS need to MAKE MONEY and do so by having customers come into their dealership. But, HOW is it okay to deceive people who are already in sh*tty situation (THEIR CAR WAS TOTALED A FEW WEEKS AGO FFS) into paying for a rental car so that they can come into the dealership, ONLY TO TELL THEM that the car they wanted was sold???? They completely F*CKED us over.
