WTF is wrong with people?
Why would the driver of a vehicle pass a cyclist, park the vehicle, and then throw it into reverse to hit the cyclist? That mentality is incomprehensible to me, but we hear stories of it again and again, this time, on Hwy 159 between Hwy 6 and Wellborn Road.

I've got kids, and ultimately, that is why I have not ridden my road bike in 10+ years. Primarily, because people are distracted, but also some are psychopaths.

I didn't know Hannah but I know people who did. I'm gutted for them and her family.

this wasn't distraction, this was straight up murder. FM 159 is a dangerous road as it is. When we lived in Millican, I dreaded the weekend because of all the bicyclists that use that road.

We do not hear stories of people doing what this guy did again and again.

There are accidents, but not outright murder.

He's already playing the "it was an accident" defense, but his past arrests show what type of person he is.

They can't use his past in trial. If he's convicted, they can use all of that in sentencing and this guy never needs to be in public again. He needs to die incarcerated.

He's currently being held without bond for violating his previous bond on a deadly conduct/discharge firearm charge, a $250,000 bond for manslaughter and a $4,000 bond for violating his previous bond on an evading arrest charge. He's facing up to twenty years for manslaughter, but if his charge is upgraded to murder, he's facing up to life.

Anybody know what the bond was for his deadly conduct charge in Grimes County?

Because whatever it was, it's too low.

His bond needs to be higher than $250k in this case.

People have done less than 20 years for murder, not every murder is a life sentence.

The reason it's not murder is because you need some compelling evidence to prove malice, especially if no video exists. Would you rather have a secure manslaughter charge that the judge can throw the book at him, or a murder charge where he could walk?

I don't know what his bond was for his 2025 deadly conduct charge in Grimes County, but his bond was $50,000 for his 2024 deadly conduct charge in Brazos County. The $250,000 bond is for the manslaughter charge, but he's now being held on a $250,000 bond for violating his bond on the 2025 deadly conduct charge, a $25,000 bond for violating his bond on a criminal mischief charge from the same case, a $4,000 bond for violating his bond on an evading arrest charge in Brazos County, and he's being held without bond for violating his bond on the 2024 deadly conduct charge.

I would rather have a secure manslaughter charge than a weak murder charge, but it looks like the charge in this case will be upgraded to murder, since the Brazos County Sheriff's Office said they're still investigating, and the evidence suggests it was intentional.

I didnt realize this was where it happened. Not victim blaming but Ive never understood why the road bikers are attracted to that road. Its literally the least safe road in the county to ride a bike. Windy with hills and no shoulder. I came over a hill on it a few years ago and had to lock up the brakes as I met bikes in my lane and an oncoming car in the other.

Im guessing this was some type of road rage gone way too far? Dude obviously had anger issues.

In addition to manslaughter, he's now facing a charge of aggravated assault with a deadly weapon in connection with the crash (his bond on that charge is $500,000). He filed a writ of habeas corpus yesterday to try and get his bond reduced, and a hearing is scheduled for August 4th. He also has a hearing scheduled for July 28th for a bond to be set on his 2024 deadly conduct charge.

My daughter was good friends with Hannah. In fact, Hannah and Will were at our pool party on the Fourth of July.
Apparently, the guy came very close to hitting them as he drove by. In response, Will threw his hands up in the air as if to say, "What the F?!"
The driver must have seen Will's reaction and become angry. He stopped his truck, then quickly backed up toward them. He struck Hannah with enough force that the impact caused her to break the truck's rear window.

Besides the obvious answer of campus, almost all of College Station's major roads have bike lanes. The 90+ degree doesn't do favors for riding, but...

I thought Texas Penal Code allows murder to be charged in cases where the defendant was culpable without needing to prove intent.

Sure we do. We have miles of bike lanes filled with street parked cars. You just ride your bike over them. It's just a little bumpy.

No, in all seriousness, I was wondering to myself 'what roads in BCS would I feel okay having my teenager ride their bike on without me, and I would feel totally safe' and realizing how few streets there were, and then asking the same question about where I grew up, which was a bigger town than BCS, but much quieter, slower traffic on small, very wide side streets. I remember my brother even riding his bike to middle school and high school a few miles away on some days. Do any kids in this 'burg do that?

This is a real tragedy and it is making me think about how we aren't really that bike friendly of a community.

Just for discussion:

Murder is a first degree felony (5-99 years); Manslaughter is a second degree felony (2-20).

In order to get to murder, the prosecution would have to prove beyond a reasonable doubt that the driver intended to either kill or seriously injure Rapp, or knew that his actions could have that result. It would probably be not that difficult for his defense to create reasonable doubt by claiming that he intended to scare her and her boyfriend, although that claim would be undermined by his statement to the sheriff's deputies that he stopped to see if they needed help, which would, IMO, the skid marks seem to show to be a questionable claim.

The argument that he was reckless in accelerating violently in their direction, which led directly to the fatal collision, is (IMO, IANAL) a much easier one to make.

The fact that he's been charged with Deadly Conduct twice, in two separate counties, would seem to show that he's hot headed and lacks impulse control, if the judge allows those charges to be brought in.

A defense attorney would argue that he was reversing quickly, in anger, so that he could confront them, and lost control. Anyone that has ever tried to back at high speed knows it's very hard to keep a straight line.

That's difficult to do.

I'm not going to go into details, but we had a family member that was the victim of a violent crime. The defendant had a history of violence that could not be used against him at trial.
At sentencing they used his entire history including arrests at school after he was 18.

Adding aggravated assult with a deadly weapon for coming close to striking the boyfriend too. I think its good strategy to pile lots of smaller charges you know you can get convictions on and trust with the history the sentencing doesnt go easy

I just learned Charles Medina is facing a new charge: Aggravated Assault with a Deadly Weapon for coming close to striking Hannah Rapp's boyfriend, William Pollalis, on his bicycle. Bond is set at $500,000 for this new charge.

William told investigators he came within inches of being hit on FM 159 the first time Chales drove by and again he was within inches of being struck again when Charles put his car into reverse and drove in reverse in their direction while he and Hannah were still on their bikes.

Medina still faces the manslaughter charge for killing Hannah and all the other bonds that have been revoked for other criminal cases pending from other cases in Brazos and Grimes County.

Total bond as of today: $1,029,000.

What do you mean by that? What you're essentially asking for is more medians and less street parking, none of which will fix FM 159.

His bond is now $200,000 on his 2024 deadly conduct charge, and the bonds on his other charges are unchanged. His total bond amount is $1,229,000.

He essentially is. $122,000 to make a 10% bond is pretty much a no bond. I'd imagine he isn't coming up with 122k….
