Deadly conduct/discharge firearm- up to ten years in prison

Criminal mischief- I couldn't find the amount of damage he was charged with causing, which would determine the penalty

He doesn't have any prior felony convictions, but he has six prior misdemeanor convictions

He hasn't been convicted yet, but three of the charges against him (deadly conduct and criminal mischief) are from those incidents.

He was indicted today for murder (upgraded from manslaughter) and aggravated assault with a deadly weapon, which means he's facing up to life in prison instead of up to twenty years

He's not eligible for life without parole or the death penalty, since his charges don't fit the criteria for capital murder, but if he's sentenced to life, he would have to serve thirty years minimum before being eligible for parole.

They can't for conviction for this offense.

If he's convicted, they can use his entire history for sentencing.

We had to go through this due to a violent crime and the DA brought up EVERYTHING that guy had done since he was 17.
