So the Lieutenant of the Canyon Police Department just called me and apologized for everything. He said that they have never had to deal with anything like this and are learning the laws and processes as they happen. He is taking over the case from the detective and filling out the paperwork to schedule a hearing as we speak. He also gave me his personal number and told me that if I have anymore questions to feel free to call him. I should be getting a court summon here in the next week or so.

My lawyer said that the Detective was pretty pissed off that I was calling around trying to make something happen and get answers when he talked to him on the phone.

I just wonder what would have happened if I didn't start making phone calls and get a lawyer involved. How many times does this happen to less stubborn people who are afraid to go up against law enforcement and hold them accountable?

Maybe that detective wanted the bike or he was just lazy.

This is what pisses me off.

For every case like yours that you spent God knows how much time tracking down, complete with convos with lawyers, judges, and detectives, there are 10 more cases of people who just accept the answer that they get and end up out time, money, and property.

Sounds to me like the detective had his eye on a dirt bike. Probably was planning to "take it by the crusher" himself on his way out to his property.

It is an incredibly low-crime city, but not that low.

WTAMU is rated as one of the safest campuses in the nation.

Sounds more like to me that the crusher would require little time and paperwork, returning to owner more time and paperwork.

Well as overwhelmed with crime as Canyon PD is, I would hate to burden them to have to do a little more paperwork. Better to just destroy a crime victim's property than have to fill out a few forms.

The Lieutenant called me back and gave me a court date and time towards the end of April so right now things are looking pretty good. .

Hope this all works out the way it should and you get your damn bike back!

I'm not anti-police but haven't ever had a good interaction with any sort of law enforcement when it comes to being a theft victim. They are always so dismissive and make me feel like it's totally my fault that a crackhead stole my ****, instead of trying to be helpful. This has been my experience with several County SOs and PDs all across the state.

Had my Kubota UTV stolen from the dealership here in San Angelo while it was up there being serviced. Have only received one call total from SAPD Detective giving me a case number. Have left him three voicemails since then and have never heard a thing back.

Luckily the dealership is awesome and they are making it right. Because the police department damn sure hasn't done a thing to help recover it that I know of. They have given me the owners to use like my own until their insurance gets this all sorted out.

Here is how it went,

The guy who had my bike surprisingly showed up to the hearing. The detective was the first one to testify and he did a very good job of stating that the evidence pointed towards the bike being mine. I testified next, I had lots of pictures printed, the police reports, and other evidence proving the bike is mine.

When I was done testifying, the Judge called on the guy who had it to testify he said "No, it is obvious it is his bike" and never testified.

After a few more minutes of looking over the evidence, the Judge awarded me my bike back. He told me I did a great job of finding my bike and that he was happy to give it back to me. He also said he thinks that the laws are written badly because I still have to pay $400 to get it out of the impound lot and that there is nothing he can do about that.

After 8 months of being gone, my dirt bike is finally back in my garage. It is a little beat up cosmetically but after a few kicks, it started right up and ran just fine. They even fixed the clutch and replaced the sprockets like I was wanting to do. After some new plastics and a few other minor things, It will be good enough to ride for awhile.

I think he was involved in it in someway. His story of how he acquired the bike didn't add up. He said he bought the bike in Oklahoma in August for real cheap because it didn't run good. First of all, the bike was stolen on Aug 29th and second, the motor was rebuilt last year and I had barely rode it so there is no way it wasn't running good.
