I apologize in advance if this topic is not technically outdoor related, but I figured a lot of Leo's posted on this board. From my understanding, I believe it is now required that written warnings must be given and documented each time someone is pulled over...no more verbal. So my question is, if I receive a written warning from the DPS for example, how long will that warning remain in their system? Is there a time limit of a year maybe or are those warnings in the system forever for future DPS officers to see when pulling someone over?

It can't go in the system... or else I'd be screwed.

In the past 5 years, I've probably received over 15 warnings (that's a conservative estimate) to only one ticket. I don't know if it's an incredible stretch of luck or cops just like me (it's got to be a little of both), but if they were seeing how many warnings I had when they ran my info, there's no way I'd be getting them so often.

Unless they play some kind of 'bingo' game seeing how high they can get some random person's warnings...

I think as of 2018 they are required to document the warnings now. I was issued a real ticket this morning for something I had previously been warned about. I was about to get another warning for the violation until the DPS officer saw in his system that I had a previous warning for the same thing. My windows are too dark. So I was just curious if this info stays in the system forever or if there is a time limit before it drops off the radar, so to speak. https://www.newschannel6now.com/story/37221052/tx-cops-now-required-to-give-written-warnings/

I have received 1 warning, the only reason I got the warning was I told the trooper I was on vacation in Colorado when my sister died. I was on my way home to Lubbock then on to Waco for the funeral.

I was doing 72 in a 70 just south of Hereford.

There is no requirement that Officers write a written warning or citation. The requirement is that we have to keep up with certain information regarding the traffic stop. We have to document the information relating to motor vehicle stops in which a ticket, citation, or warning (including Verbal Warnings) is issued and to arrests made as a result of those stops, including information relating to:

(A) the race or ethnicity of the individual detained;
(B) whether a search was conducted and, if so, whether the individual detained consented to the search;
(C) whether the peace officer knew the race or ethnicity of the individual detained before detaining that individual; and
(D) whether the peace officer used physical force that resulted in bodily injury, as that term is defined by Section 1.07, Penal Code, during the stop;
(E) the location of the stop; and
(F) the reason for the stop.

I don't work for DPS, but I don't know about any database that keeps information on written warnings, but I doubt there is one. The more likely scenario for the Trooper knowing about your warning would be the Trooper that wrote the original warning, recognized your name and notified the Trooper that had you stopped.

I got a ticket for 2 mph over outside of Dalhart on a ski trip in the mid/late 90's.

Had to pay a fine
Given a choice between deferred for 18 months or defensive driving and deferred for 6 months.

Couldn't take dd on the web at that time and the instructor NEVER changed tone or inflection so I fell asleep after lunch. Had to take the whole thing twice.

when i was in outside sales driving to drilling rigs, I got pulled over a lot by state troopers. I was usually going 5 miles or less under the speed limit. Never received a ticket by them. Only warnings.

The DPS in the Panhandle was no nonsense back when I lived and traveled out there. Yes, they would pull you over for 2 over in near Hereford and Tulia.

My last ticket was for 78 in a 70 near there. I.was doing 70, the trooper lied.

I believe the Texas DPS ticket actually says something like the following:

Exceeded posted speed limit (by more than 10%.)

That last part seems to mean that Texas DPS at least, won't give you a ticket for less than 10% over. I could be wrong, and I would bet, if you are a jerk to an officer, you are gonna get one anyway.

I always stick to my best manners and stay calm, when pulled over. This works for most stupid things I do, which on the road, are rare, on purpose.

I got a ticket, post Ike in Galveston, for 17mph... it was on a street that had been wiped out by Ike and was essentially just maintained sand and had no posted speed limit signs. Apparently, the speed limit was 10mph but there was not a single sign in place (and even the officer acknowledged that fact). After digging through the traffic code and two court appearances citing such code, the DA threw it out. Most ridiculous crap I have ever been through.

I'm pro law enforcement but I am not pro-DB.

Anyone else ever take the defensive driving you could rent from the movie rental place? Had to watch the video and then call into a 1-800 number and answer questions.

Related observation/question on law enforcement databases - I had never in my life received any kind of a warning for traffic stop (always got a ticket) until the day I got my LTC. I honestly thought warnings were a myth. Since my LTC I have received several warnings, even a couple from DPS (who rarely gives warnings).

Here is my database question - I drive a company truck - not registered to me in any way. The last 2 times I have been pulled over (1 DPS and 1 local E TX PD) I was not carrying and forgot to present my LTC with my DL. Both times I quickly realized and immediately told officer and asked permission to go back in my wallet for LTC. They both told me they already knew I had the LTC and no need to get it out.

This was before they returned to their car to run my DL etc. - all they had was the license plate number of the truck registered to company (not me).

How did they know who was driving the truck, much less that I had a LTC?

I had been previously pulled over driving this truck - so I assume that info went into a database that both DPS and Local PD has access to?

Not a huge deal, but freaked me out at the time.....

My only ticket in 24 years of driving is a 22 in a 20 in a school zone. I still don't think I was speeding. I fought it in court. The cop said I was actually going 27 but he only wrote down 22. Not sure why that didn't cause it to be through out then but the judge sided with the cop.

The warning database is an old urban legend. I remember rumors about it starting up at least 15 years ago.

They don't go on your official record, but they are entered into their internal system on their mdt. They don't have a "retention period", it's just there as a record entry.

They can search for your name, it shows every ticket or warning that has been written through the system. Almost every police department in Texas has something similar, but most of them don't sea3ch each other.

It probably was noted on their MDT entry. Running the LP through the state system doesn't tell them you have an LTC, but running the DL does.

Got a ticket outside of Abilene, near Clyde turning into my wife's grandparents place because my seatbelt was off. It was during the national click it or ticket campaign.

He told me since i didn't click it, i get a ticket. Word for word. I remember being stunned when he said that.

Definitely doing the drug stop. You prob were not driving a flashy vehicle of any sort either. Drug runners generally try to be low key.

Cannot speak about state or any city but mine Round Rock and they definitely track warnings here. LEO specifically told me I had one on my rear end light which was continually shorting out. Pulled over three times for it before I sold it.

Finally I just put a replacement in the back and when pulled over I show it to them and told I was on my way home to replace it

about 3 years ago I was on my way back to Houston from hunting at a buddies place near Winters. On 183 southbound from Brownwood. Approaching Zephyr I got pulled over and given a warning for going 5 mph over the speed limit. Kinda lucky b/c a few minutes prior I was about 7-10 over but knew nearing the town that was too much.
DPS trooper turns around and heads back northbound and I continue thru Zephyr. Hit edge of town and put cruise on 5 mph over and about a mile south of town got hit by DPS again. Given another warning.
they gave these electronically printed warnings so I know they had to be entered into some sort of system.
So if they have a way to see the warnings I would be certain I would have gotten a ticket instead of the second one just minutes apart!!

For both of these warnings and others I've always pulled WAY off the shoulder/road. They always ask and I always say it's to make sure we get both of us well away from the road. I think they appreciate that.

I still have the warnings in my glove box
