You are correct. League can't appeal the facts she determined. And does not want to. The are appealing the punishment.

Unless the NFLPA files an appeal to the 6 game suspension by end of today, the 6 games will stand. Any court case filed against the NFL if the suspension is increased would not delay the 6 game suspension.

Part of me is curious on whether the NFL actually wants to drag this out. Every team outside of Cleveland, and the NFL itself, are miffed about his contract.
