"Ben asked us to go to his 'VIP' area. . . .  We all went with him.  He said there were shots for us, numerous shots were on the bar, and he told us to take them.  His bodyguard came and took my arm and said come with me, he escorted me into a side door/hallway, and sat me on a stool.  He left and Ben came back with his ***** out of his pants.  I told him it wasn't OK, no, we don't need to do this and I proceeded to get up and try to leave.  I went to the first door I saw, which happened to be a bathroom.  He followed me into the bathroom and shut the door behind him.  I still said no, this is not OK, and he then had sex with me.  He said it was OK.  He then left without saying anything.  I went out of the hallway/door to the side where I saw my friends.  We left [the club] and went to the first police car we saw."

As it turns out, the alleged victim gave two handwritten statements.  The statement given after the passage of time is neat and legible.  The earlier one is hard to read, since it was written while the alleged victim was still intoxicated.  Here's part of what it said:

"His bodyguards took him back to the rooms w/bathroom and I said, 'I don't know if this is a good idea' and he said 'it's OK.'  He has sex w/me and meanwhile his bodyguards told me friends they couldn't pass them to get to me.  My friends found me & talked to a Milledgeville policeman and he said to report it."

During his Monday press conference, district attorney Fred Bright mentioned the sketchy initial statement followed by the more detailed second statement.  He also pointed out that, at the hospital, the alleged victim said, "A boy kind of raped me."  Moreover, the officer who received the initial complaint wrote that the alleged victim's recollection was "foggy from to [sic] her intoxication level."

The inconsistencies in her statements and her intoxication create fertile ground for "reasonable doubt."  Though this gives rise to an unfortunate reality that women who are intoxicated will have difficulty obtaining justice if raped, the fact remains that our legal system employs a high standard of proof in order to ensure that innocent men are not wrongfully imprisoned (notwithstanding all of the supposedly innocent men who already are in prison). 

Meanwhile, we detected a strong degree of consistency and credibility regarding the statements from the alleged victim's friends, who nevertheless could contribute only circumstantial evidence to the investigation, since no one saw the exchange between Roethlisberger and the alleged victim.  For example, Ann Marie Lubatti said that she saw Roethlisberger's bodyguards guide the alleged victim to a side door, and that two minutes later she saw Roethlisberger walk back there.  "I immediately went up to the other bodyguard and said, 'this isn't right,'" Lubatti said in her statement.  "'My friend is back there with Ben.  She needs to come back right now.'  The bodyguard wouldn't look at me, he just said, 'I don't know what you are talking about.'"

Lubatti wrote that she saw Nicole Biancofiore approach the manager of the nightclub, and that Biancofiore told him to unlock the door to the hallway.  The manager said, "Ben's an NFL quarterback, he won't do anything to ruin his reputation."

Lubatti also corroborates the allegation from the alleged victim's legible statement regarding Roethlisbergers "***** already out of his pants."

Nicole Biancofiore's statement corroborates much of Lubatti's, but does not mention the remark about Roethlisberger exposing himself upon entering the room. 

So while Bright concluded that he could not obtain a conviction (he said Monday at his press conference that he didn't believe there was even probable cause to arrest), Bright echoed on Monday the opinions of many regarding the evening in question.

"It is unclear, it is foggy, what exactly happened in that bathroom," Bright said, "but if I was there coaching him I'd say, 'Ben, you don't need to do this.  You don't need to put yourself in a position where you're alone in this dingy bathroom with you and this girl.  That's foolish.  Grow up.  You need to be a role model.  You need to be a role model for your team, your city, the NFL.  You can do better.'  And I hope he's learned something from this.  I really do."

definitely a creeper, but still no proof of a crime.

At this point, if the Steelers feel he has embarrassed them to the point of looking to trade him, I'd be ok with it.

I knew once they released the juicy details it would do more damage than the DA the other day.

I wonder if they are actively moving to trade him right now.

I heard Rooney on a radio show this morning... he sounded pretty pissed, didn't give Ben any sort of vote of confidence, and even seemed a tad embarassed by it... I'd put about a 75% probability Big Ben's taken his last snap as a Steeler.

Although he's not been proven guilty of anything, 2 sex accusations just look horrible. Rooney is a pretty class guy... I can see him maybe shrugging one off as possibly a false accusation, but not 2.

yeah, I tend to agree.

Although, with a hefty suspension and further embarrassment, if they did stick through out...I really doubt he'd ever put himself in a position like that again.

They just now have to decide on whether or not their short-term reputation is worth keeping him around and seeing him through his "transformation," or really showing the league something, and making a move.

I'd be ok with both, honestly. He hasn't been committed of any crime. This one is MUCH, MUCH worse than the first. That first woman is absolutely insane, and all of the evidence in that story points that direction. This second incident is disgusting, and all the evidence points towards Ben going ultra-creep on some drunk 20 year old.

We all know that if he did stay around he'd be at strike 2 1/2...and anything else he'd be gone. They now have to decide if it's worth it to keep him on and stick with him through this. To be honest...that's a really tough question.

I am sorry, the only reason she dropped the charges is she didn't want to relive the situation over and over. The guy is a scum bag.

Anyway, just MHO. Maybe I am overly sensitive to the topic.

I wouldn't be surprised to see big Ben end up in Arizona.

I've known PLENTY of girls that have been "railed in the bathroom" by myself and other guys with as much or more money and fame than me and they haven't cried rape much less gone to the cops immediately after the incident.

His agent/manager/publicist had to have told him Rule #1 a few times.

I don't know. Between the 2 sex accusations and the motorcycle deal, it is obvious to me that Big Ben is a serial dumbass. Sometimes serial dumbasses figure it out and get it, but not often. You can make it on talent in the NFL for only so long. When you have a general numbnuts/idiot as one of the leaders on your team, teammates start to see right through it... I think that explains Hines Ward calling him out last season a little bit.

In my opinion, the dumbaceness did not stop at the incident. I know it is minor, but minor issues add up in a situation like this. When you are coming out with an "I'm sorry" press conference like he did on Monday, you should not come out looking like a WWF wrestler in a beatup polo shirt. Obviously, someone got to him and he was suprisingly clean cut when it was time to goto the commishes office.

On another topic, I am not condoning Tiger Woods by any stretch of the imagination, but, if true, this is 100 times worse then what Tiger did. However, Ben has not had to deal with 1 percent of the crap that Tiger was/is dealing with.

he's also not the face of his sport, the most marketable athlete in the world, and almost a billionaire.

Also, ESPN and others have covered the story so much, I could have sworn he did this at least 3 months ago. It's a month and 10 days old. That's still extremely fresh.

I'd say for his status as an NFL Star QB, he's getting PLENTY of coverage for being a creep.

Oh, and he's also not married. There haven't been a slew of *****s, prostitutes, waitresses, porn stars, and neighbor's daughters to come out and say Big Ben slept with them either.....yet

it's certainly possible that the 2nd one is targeting him, but I think the idiom "fool me once, shame on you, fool me twice, shame on me" is apt here. Roethlisberger now gets a much closer eye on him now. hopefully he gets a sizable punishment from the league, the steelers or both.

she has absolutely no credibility, her co-workers have stated she lied about some relationship with a made up soldier overseas, then she said he died. They said she would call Ben her BF, and gleefully talk about it. Then a LONG time goes by(months)...and out of the blue she files in CIVIL court?

c'mon. Ben tagged a girl who was working as a hostess at the resort, she turned out to be a loony, and somewhere along the way(I believe this was after she was fired a long time later) she decided to get money from it.

Like I said in the other thread about him...the first incident I was completely in support of him as far as the allegations because everything that was dropping each day was news on how messed up the woman was, and how she had told people about it and was happy about it, then 6 months go by and poof...lawsuit.

This second one is just ****ing weird. He's obviously a creeper. the 2nd situation by itself is one that would warrant suspension, and possible trade now that the juicy details are coming out.

Eric Williams of the Cowboys filmed all his escapades for this reason. Maybe he enjoyed the video as well, but it was mostly to cover his backside. He and Michael Irvin were accused of rape by some blackmailers. He had video evidence that proved otherwise. He also made a mint from overzealous DFW television stations.

If there was physical evidence like semen or bruising, Big Ben would be in Big House right now. No corrobarating evidence to confirm the girls story.

Technically, he did committ a crime. You can't walk around with your weiner haning out. The DA could get him for indecent exposure in about five minutes.

this is an interesting dilema for the Rooneys. Almost like a best 2 out of 3

- still in denial about the 70's Steelers steroid abuse. See no evil, hear no evil, etc..,

- but then pushing through the Rooney Rule because they were so horrified at the NFL's hiring practices. Had to make sure justice was done.

and now this situation. Anything less than a 3-game suspension equates to see no evil, etc..,. Or they could jump to the aid of women everywhere (like they did with the Rooney Rule) and play the role of righting-the-wrongs of society.

Cheating on your wife with a consenting woman (or 15) is not even in the same league as rape. Not condoning Tiger, but he was never accused of rape (at least not that came to light) but has suffered a lot more damage then Ben has.

You had a couple of girls state that he was exposing himself. That is enough to win the case. Of course Ben is gonna deny it, every defender does.

If they girl didn't back out of it, they probably would have taken it to trial. I never saw anything saying there was no physical evidence. And I never saw Big Ben deny that he boned her.

That Blash cop sure seems like a sleaze. Covering up a rape because he's starstruck and on the payroll. I can't believe he conducted the interviews.

One of Roth's bodyguards is a Penn State Trooper. He's under some heat too. Basically, he good description is find drunk girls, allow boss to rape them, and have plausible deniability.
