True, but even then, charge her with something like brandishing. To me things kind of "reset" when she has gun pointed at him and he starts acting aggressive and rushing after her. She seemed to genuinely fear for her life…even if she may be an idiot and maybe shouldn't have pulled a gun to begin with. But she was clearly dealing with a psycho who she thought would be scared off and leave her alone after pulling her gun.

Watched one time at the gym an altercation/road rage over a parking spot. You're at the gym! Park a little further away and walk a whole extra 20 steps!

My wife was accosted and then followed by a guy in a car yesterday over waiting to turn into a parking spot just yesterday.

Yelled at by him.

Followed her in his car all the way to the entrance of Walmart (in the junction of Keller, Colleyville and NRH, so a nice spot) yelling at her and calling her names.

If you want to get confrontational over a parking spot, you can deal with the consequences. But if you want to be a civil and normal human being, let it go.

For what it's worth, I think Branca is a blowhard and he definitely pushes an agenda, but this is his current take (with the caveat it may change ofc)

Not by much under Florida law. See my post above about verbal arguments with no physicality does not justify pulling a weapon and is in fact a crime, Thus when conducting a crime, no self defense.

If my wife life felt threatened enough to have a gun ready, and somebody approached her after she repeatedly told them to back down, then yes, empty the magazine.

I always look for spots further away and not too crowded. Not necessarily anticipating this situation, but it just seems easier than fighting for a close tight spot.

The lesson here is to behave in the parking lot. Society is little bit more polite today. The lower the bar for self defense the more polite we become.

Stop ****ing around and finding out over a GD parking space.

Not worth it. Courts will work it out, but people need to stop acting so foolish over trivial first world BS.

We have defensive driving courses taken for tickets. How about a DEFENSIVE LIVING course for everyone to take in HS. This is so dumb.

I have 61,000 miles on my car and not a single door ding. I won't park my car anywhere close to another vehicle in most circumstances. I get extra steps along the way as a bonus. Something most of these people fighting over parking spots desperately need

I never thought it would rise to the level of a murder conviction, but I still don't think it was "a good shoot." But if Branca surprises me and says she'll skate on all charges, I guess I owe anyone who wants it control of the world and a Bud Light!

Branca is unsure in this situation, how the Florida SYG laws will affect this case. But voluntary manslaughter is not nothing. Just not a death penalty case.

I would hope he gets Steve Gosney on a stream, since he's a longtime Florida lawyer who mostly worked in the Public Defenders office in Daytona until the last few years. Steve is in private practice now but when he was in the PD office his work was mostly appellate work. So he is more than familiar with self defense cases in Florida.

I've seen videos of people continuing to approach people with guns drawn and pointed at them, like this one. My brain will never be able to wrap itself around why they continue approaching. I'll never, ever understand that.
