You are welcome. The UCMJ is a completely different animal than statutory criminal law. It is more a Code of Conduct for military members (and their families as active duty are held responsible for the conduct of their dependents) that is 24/7/365 not just work related.

Even first amendment rights are curtailed in that you can say what you want but not when active and in uniform.

When my dad was stationed overseas the crimes committed by their son resulted in the family being sent back to the US. Indeed the Code of Conduct was followed in the early 1960s.

Really all of them, especially Kelly need to shut up about this and get it out of the news cycle. Stop poking their heads up. Let it drop off of the radar. Refusing to cooperate, with counsel present just keeps the subject in the news.

Every military member knows that they are not required to follow unlawful orders, so the video was completely unnecessary.

Kelly, for sure, knew better. Completely shamed himself and his service in my opinion. I have no respect for him. Zero.

I was under the assumption that these FBI interviews are for federal crimes committed as a civilian and that the JAG would have their own investigative teams for any violations of the USCMJ? The latter would of course only apply to Kelly. You think these FBI interviews have anything to do with the DOW investigation into Kelly's violations of the USCMJ?

They will be on separate tracks of course but what happens in a federal investigation will be noted in an investigation under UCMJ too.

Remember UCMJ is a Code of Conduct which is different than statutory criminal law. Not the same animal at all although they can intersect, at times.

Then yes, because if there's something different that I'm not aware of, they have the same rights as a regular citizen to remain silent. If this is an ethics committee issue, then that's different. If this has to do with military issues, I don't know what those are.

We were discussing FBI interviews (which implies federal crimes) and I basically stated that left wing juries will get these people off. Richard asked me if court-martials have juries, which is irrelevant when discussing FBI interviewing all six of the seditionists about potential violations of federal crime. I'm not sure why.

It's not a nothing burger, these people knew what they were doing and should be severely punished for their reckless crimes. That being said, probably won't happen, because Democrats are not held to same standards as Republicans by the media, federal law enforcement, or juries in Democrat enclaves. Just because they won't be held accountable doesn't mean that their crimes should be ignored. An attempt to hold them accountable should be executed to the full extent of the law.
