Which monument would that be and to whom?

When you have TDS, everything in the world is all about Trump...

Trump has been in a frenzy building and naming things as monuments to himself. Trump is the one making everything about himself!

This isn't a monument to Trump and you know it. It's a much needed addition to the White House complex. One that will benefit presidents of both Parties for decades to come.

If you guys had just left him alone 10 years ago and let him serve out his first term in relative peace, none of this would be happening. But you couldn't stand it, so you went in guns blazing, and in the end all it did was get him re-elected to a second term four years later than it should have been. And y'all gave him four years in between terms to figure out how he was not only going to accomplish his agenda, but to go nuclear on your side along the way. Look on the bright side. You've only got 2-1/2 more years of Trump.

He had his name added to the Kennedy Center, you an count on his name appearing on the "big, beautiful ballroom, if they ever get the catastrophe of the reflecting pool straightened out, a plaque with Trump's name will probably appear, the Arch de Trump is on it's way. Probably a giant statue to the narcissist is in the works.

Again, none of this would be happening if you had just accepted 2016 and moved on. You mess with a guy like Trump, particulary trying to destroy him politically, financially, and personally, he's going to mess with you 10x worse if he gets the chance. The left is reaping exactly what they sowed.
I did accept that Trump lost by 7 million votes.
I'm not even referring to the election. I'm talking about illegal spying, RussiaGate, and two sham impeachments, lawfare. Your side has given Trump more than enough justification to yank your chain hard every opportunity he gets. And by all accounts, he's got you guys so flustered you're in a perpetual state of Reeeeeeeeeee. You're giving him exactly what he wants.

To believe that Biden got more legitimate votes than any candidate in history before or since, all without campaigning and with very limited public appearances, staying mostly in his basement, requires an almost religious fervor. Or, extreme gullibility.

Do Roberts punt this down the line to the point of no return regarding g construction?

Seems like they are already there now but certainly with work continuing.

Yes but he should rightfully have given directions to dismiss with prejudice due to lack of standing. Someone is writing an emotional dissent, I suspect. SCOTUS can do whatever the heck they want with this stuff.

I don't think thats how it works.

Can you name a case where SCOTUS directed a lawsuit be dismissed when ruling on an application for administrative stay? I don't have any idea, but "never" is probably a safe guess!

Love your takes and you are right about the general patheticness of Roberts but your RDS is showing a bit on this one!

It wasn't a "punt" but that's the effective outcome. By the time a ruling on the merits is made, it's going to be well passed the pound or no return even if Trump loses.

Absent standing, aka a live controversy, dismissed with prejudice. That's the crux of the issue.
Quote:

In light of respondents' aforesaid representation to this Court, there is no longer a live controversy between the parties over whether a federal court can hear the equitable claims, and the abstention issue is moot in this regard. Accordingly, the portion of the Court of Appeals' judgment addressing those claims is vacated, and the case is remanded with instructions to dismiss the claims with prejudice.

So yes, it's happened. And Scotus/Roberts himself have often attacked standing, to an infamous degree even. Mootness is a much more discrete issue vs. standing.

I think that is all I was saying. Admittedly I did not read any of the case or details, you legal folks can have at that. From a common-sense, logic and reasonable person standard, what Trump is doing should be cheered by all Americans who actually love this Country. Instead there are lawsuits and jeering because Orange Man must be stopped.

Ironically, the TDS-ed have the same approach to Trump as the IRGC. Harass him then wait it out until the next election and have Dems undo everything., which is somehow what is best for the Country. Truly bizarre behavior.

Deakins was AFTER oral arguments on the merits! The case had been fully briefed!

In Arave, they granted the party's motion to dismiss his appeal!

In neither case was it a situation anything like what we have here! The Administration asked for a stay, and got it.

So keep looking for a case where SCOTUS dismissed a case when all that was asked for was an administrative stay.

Why didn't Thomas or Alito say the case should be dismissed right now? Since the Court can just do whatever it wants without regard to process.

I'm not looking for anything. The posture differences can always be debated. It was a statement/order from the chief justice, not a per curium etc. decision, and you'd asked about a previous case dismissed with prejudice by scotus.

The process matters less than the politics to Roberts, and that's all I will say about that here, as with his statement admonishing Trump for his comment about 'Obama judges.'

I assume justice DEI is ripping out a lengthy lone dissent on this one. The stuff that Kagan and even sotomayor would roll their eyes at.

That said, by the time anything substantive is done in this case, the project will be done. What is the district judge doing to do in the event that the plaintiffs ultimately actually win? Command the president to tear down part of the White House?

There isn't much of a debate. Here, we have a Justice granting a stay requested by a party. In the two you mentioned, there were requests to dismiss the case. The postures were nothing remotely similar.

Quote:

, You realize this kind of statement is how SCOTUS always handles a request for administrative stay, right?

Quote:

Nope. My specific question was: Can you name a case where SCOTUS directed a lawsuit be dismissed when ruling on an application for administrative stay?

I don't disagree at all! But that has nothing to do with what happened here. I again bet you can't find a single case where any Supreme Court justice sua sponte dismissed an entire case based on an application to stay. It just doesn't make any sense that would ever happen.

Trump wins...

Quote:

The Supreme Court on Monday handed a win to President Donald Trump by allowing him to move forward indefinitely with the construction of his new White House ballroom.

The court, divided 5-4, granted an emergency request filed by the Trump administration, blocking lower court rulings that would have put the aboveground portion of the project on hold. This followed an interim decision along similar lines issued by Chief Justice John Roberts on Aug. 21.

The legal challenge was brought by the National Trust for Historic Preservation, which argued that the president did not have unilateral authority to proceed with construction.
In the unsigned ruling, the court said that the trust likely does not have legal standing to bring the underlying lawsuit. The court did not reach any conclusion on whether Trump has authority to carry out construction without congressional approval.
