Alina was not a part of the criminal cases; she was only involved in the civil cases. In those cases, she went 0-fer and got hit with a $937,000 sanction in the lawsuit against Hillary Clinton. You have to royally F up to get that kind of a sanction. Of course, maybe you and I have a different definition of effective.


937k was peanuts in the civil cases and again Trump's president right now despite 100 charges against his ass so guess what she was effective he won the court of public appeals and that was her job.

I have praised and criticized Trump the same as always, based on what he does. Still very happy to have voted for him and with the job he is doing overall for sure, just don't agree with everything.

I said the traditions Reagan broke down were for the good of the country. Just pointing out that it isn't just Dems that have broken from tradition. It seems like most modern Presidents have done it to some extent.

Ship seems to think the judges will ignore this, and as well that her nomination will be withdrawn.

I think he's wrong, in this instance, but he may be partially correct and Trump will use this to challenge this law as unconstitutional (which I think it is, giving the judiciary a right to appoint an officer in the executive branch).

No doubt Trump is going to fight on the who is in charge in NJ issue, but he has no choice but to withdraw Habba's nomination. You can't be the nominee and be the acting.

She will just be "Acting" for the next 3.5 years**

March 24, Habba is named interim US attorney "effective immediately". March 28 she is sworn in. by law she can be interim only 120 days.

In late June, Trump nominates her to be US attorney

120 days after March 24, the judges in New Jersey name first assistant Desiree Grace as US Attorney because Habba's term expired. The law expressly allows them to do this.

Trump argues the 120 days started when Habba was sworn in.

Bondi removes Grace as first assistant

Habba resigns as interim US attorney

Trump withdraws Habba nomination

Habba named new first assistant by Bondi

Beside Habba is highest ranking person in the office now, she becomes Acting US attorney.

Questions are:

(1) what date did the 120 day period start?

The fact that any judges have any say in the appointment of any prosecutor is crazy to me and seems like a major conflict of interest.

Trump has not challenged the constitutionality of that law in anything I have seen. and thats likely because in this case (where a defendant is saying Habba didn't have authority to act) its not relevant.

after 120 days, she was no longer interim US attorney. That the judges appointed someone else is not really relevant here. but I expect that may come up in some other case or issue

my guess is the law was put in place so the courts could still function in the face of non-action by the other two branches. someone has to do the job, so you don't want a situation where the senate won't confirm someone and executive won't name an interimm
