Interesting take. The few times I have heard I speak I was actually impressed.

Isn't the attorney that they selected to replace her a Republican with significant federal court prosecution experience?

Even though she is Republican, she must not be politically active enough since AG Bondi reportedly removed her from her position to make her ineligible to take the position.

Does competence no longer matter?

James Comey was a "Republican." Chris Wray is a "Republican." They're corrupt to the core.

The law flat out says they can do this after a 120-day term expires.
Quote:

If an appointment expires under subsection (c)(2), the district court for such district may appoint a United States attorney to serve until the vacancy is filled. The order of appointment by the court shall be filed with the clerk of the court.

https://www.law.cornell.edu/uscode/text/28/546

And the POTUS/USAG can remove the court's choice and appoint someone else.

CAN do it does not equate to SHOULD do it, agree?

IMO, they should have appointed Habba because that is who the President wants (regardless of their or my personal feelings)

Interesting question for you.

Trump appointed her for a 120 day assignment.

These judges essentially removed her and replaced her.

Since she is no longer the USANJ (and not because of Trump)...can Trump just reappoint her for another period of 120 days? Are there rules against that?

Incredible, if true. Wouldn't surprise me at this point.

One slight correction, the judges didn't remove Habba. She was removed as a function of law. The judges replaced her, but they could have extended her if they wanted.

As to whether he can just name her again, I have no idea. Nothing in this specific statute prohibits it. If the judges could extend her, why can't president do the same?

But there are lots of laws out there! Lol.

In modern politics, it is more about the show and virtue signaling than competence in many cases. Sec Pete for transportation as one example from Biden among many and Trump has his fair share. Here is a lawyer that I haven't heard too many lawyers say she did a good job defending Trump in the court case and made many rookie mistakes but she looks good and is totally loyal which he of course values.
Ellis Wyatt

Surely it's true. Them removing her is a pure partisan political act. Theres no legitimate reason for them to do that. How many times have Republican judges done the same?

Does anyone think it's a coincidence that this happened where the congresswoman trespassed at an ICE facility? This is not a routine action done for legitimate reasons.
Ellis Wyatt

Yes, but it's always democrats breaking down traditions. It's always democrats attacking the rule of law. This is just the most recent example.

Like I said she's great on TV as she can speak well and she's hot. Under the hood though she worked in the fashion industry and wasn't doing well so she went to Widener for law school and then had a few years of very unimpressive legal cases but met Trump at Bedminster and got on his radar a few years ago. I doubt it was because of her adept legal mind.

I have nothing against her but she is what she is.

it is unfortunate that Trump mostly determines competence based on physical attractiveness rather than innate talent.

but it is what it is.

And none of that has a thing to do with what these judges have done.

None of it has a thing to do with why ZERO US Attorney nominations have been confirmed for the Trump administration.

We need more Iraqi immigrants like her parents. My father in law is from the Iraq/Iran border region, and I can personally verify that's top shelf genetic material.

Seems like the Senate should get off their duffs and start bringing votes to the floor on all these candidates.

I agree fully. I am guessing it has something to do with the blue slip process, which democrats have unethically abused starting in Trump's first term. They are attempting to paralyze Trump by any means necessary. Nevermind "peaceful transfer of power."

Agree but as I mentioned I think he actually played this well. Dems look bad removing her but the reality is she was likely to be ineffective and possibly even screw something up if she stayed because she simply is unqualified for the job. Yet now Dems look partisan and Habba gets to be a martyr who can go out and do what she is good at, going on TV and being fired up looking hot for Trump. Bondi fired her replacement and now they can hopefully put in a hardass who actually is a good lawyer to replace her and the Dems are going to have a very hard time opposing them.

Best thing the Dems and judges could have done is left her alone until she falls on her face making some legal error which she likely would have. At worst she was unlikely to effectively prosecute the cases she was pushing for. Now they martyred her and gave Trump a W and cover to name someone that's a real threat to them.

I want to make sure everyone sees this. She wasn't taken out of her position by the judges as she was always an interim U.S. attorney that was going to be subject to this extension vote. It is correct that they chose not to extend her though. Just want to make clear that federal judges don't have the power to remove US attorneys.

Maybe she could have benefitted from not going 0-fer each time she represented Trump.

To be fair, not having standing because your client had yet to be harmed is a ridiculous way to lose. That's how 99% of those cases ended. Did you know about standing? Serious question.

The judges did not vote to extend her term. They only did it as a political move.

Dems fell into the trap on this one. Habba is hot but a terrible lawyer that went to a joke of a law school and was cringe in her legal arguments for Trump. She's great on TV though and will play the role of martyr very well. This just gave Trump some great ammo and he now can actually replace her with someone that is a real bulldog and actually understands the law.

Would Trump hire a stupid person to keep his ass out of jail?

Did Trump get nailed by any of the a thousand charges the Democrats falsely went after him for?
Considering the CIA FBI doj Obama Clinton
Biden all were against Trump and he still beat him
That say he's done pretty well. And habba obviously has done well for him. Do I think that she had lawyers underneath Him doing the heavy lifting sure but Trump also wins the court of public appeals and having a lady who's gorgeous and smart and talented as the face every time they interview her that's winning.

There's effective and ineffective it sounds like she was effective.

Since when do qualifications matter to democrats? There is a Supreme Court justice who is dumber than a tree stump. You tried to elect Kamala Harris, for goodness sakes.

Just one Supreme Court Justice?!

3 that are hyper partisan, 1 that is dumber than a stump.

Which is which ? ?

It seems that at least two of them are competing for the Dumbest Title

Alina was not a part of the criminal cases; she was only involved in the civil cases. In those cases, she went 0-fer and got hit with a $937,000 sanction in the lawsuit against Hillary Clinton. You have to royally F up to get that kind of a sanction. Of course, maybe you and I have a different definition of effective.

You need to take off the blinders a bit if you are claiming that Trump just makes great hires and that includes lawyers. I mean Cohen worked for Trump for a long time for instance. He makes some great hires and decisions but he makes plenty that aren't. His skill though is adjusting and that's how he is so successful. Habba also made some mistakes in the case she defended Trump (which he lost).

Like I said, I like her and I even think Trump is using this whole thing to his advantage. That doesn't mean she is a good lawyer though, knowledge and practice of the law isn't her strength. Happy to have her on the team and for Trump to utilize her as best he can but she was basically like hiring a coach of a 3A HS football team that went 6-6 to replace coach at A&M. I mean there are times it ends up being a Ted Lasso situation and works out but not often.
