The law doesn't care about 5.5" or less for anyone. It considers it a pocketknife and isn't going to tie courts up with who had one where, whether they are 17 or 19. Schools may have a policy, but that's not law. If they could have charged him for having the knife, I'm sure they would have.

You are correct. It is not criminal to carry a pocket knife (less that 5.5") on school grounds. But it is a school student conduct violation in almost every district. This means only subject to school discipline for possession only for under 5.5

Yes that would not be criminal. Letter of the law (PC 46.03) says that school premises are usually interpreted to mean only inside the physical building. The law uses the term premise and then further defines it as physical building and specifically says not sidewalk or parking lot. Would more than likely fall under the same school student conduct violation and more than likely the district would move for expulsion

Thanks. Growing up when I did, trucks with gun racks and guns visible were no big deal.

But now with "zero tolerance" didn't know if the law has not been expanded.

So I texted a buddy of mine from WAY back who does criminal work in the DFW and surrounding areas. "Hey, you handling the Frisco Kid's case?" (I was sort of half joking). Him: "no, but a friend of mine is." I won't go in to the rest of the conversation as I don't think he meant it for public consumption. Nothing he said would cause enough heat to even moderately warm up a danish, so no need to worry about it.

Anyway, I get online and the kid has now requested a PD! Still waiting to hear from my friend if his friend withdrew.

I have confirmed through the online Collin County records search that he did, indeed, submit a filing entitled, "TFDA Indigent Packet - Attorney Appointment Eligible." Perhaps Texas criminal attorneys can chime in on that.

I'm having a hard time being upset about this piece of **** family grifting these hundred kf thousands of dollars, honestly.

Why?

1) he is still headed to prison, his life is trashed by his own evil actions. And tiny arrogant dudes like him don't do well in prison either.

2) the family will blow all the money inside of 3 years and be poor again

3) 100% of the stolen money came from garbage individuals donating out of racism. I'm glad their money got stolen.

Holy cow. I didn't notice this earlier, but the judge in this case is one I've appeared before. That was a civil case -- Collin does Civil/Criminal in all their County/District courts, I believe. Anyway, its been a while but the guy is a no-nonsense judge who is firm but fair. I liked him, even though he didn't always rule in my favor on the case I had him for. He "reminded" me to take care of something but in the next hearing, granted the relief I was asking for on an obscure motion. I never felt like he was either playing favorites or solely focused on moving his docket along.

I don't see this guy getting intimidated by any public group's pressure. I also think any hearing on any supposed indigence is going to be tough going given the social media fundraising effort. I may go sit in on that.

But PC 46.03 also includes, "on any grounds or building owned by and under the control of a school or postsecondary educational institution and on which an activity sponsored by the school or institution is being conducted" in addition to, "on the premises of a school."

That is typically understood to be non-instructional premises of the school, such as bus barns/admin buildings/Ag barns off campus. Also other non-school settings that the school uses. Frisco plays football/soccer at the Ford Center and Toyota Stadium. Those facilities become "campuses" as far as criminal statutes are concerned, even though they are not owned by the school and are not primarily school places

Are you still eligible for a court appointed attorney if you're out on a $250,000 bond? If you are requesting a court appointed lawyer then you should be remanded to custody while you await your trial

As for Anthony, the amount of money the donation account has in it is irrelevant because he does not control it. It's not his money. The guidelines of the Collin country court say the judges can't consider what resources the family has. Only Anthony's assets, which are likely nothing

I don't think so. If you look at the wording on it, it's very broad. "This fundraiser has been established to provide comprehensive assistance to the Anthony family as they navigate the many challenges surrounding Karmelo's case.".
