Okay two terms that perhaps need some clarification for IANAL types.

Prima facie means on the "four corners" on the page. A very clear cut case exactly matching an established legal claim or assertion.

However, first impression means the legal claim is a novel one that has not been adjudicated before. In Garcia's (and Comey's) case what is novel is the assertion of vindictive prosecution as a criminal defense and not a civil claim brought AFTER prosecution.

So prima facies and first impression do not collide in the pretrial phase.

If plaintiff agree with DOJs interpretation of what was meant by the phrase, why does the judge have the leeway to decide it means something else. Sounds like acting as senior legal review for the plaintiff instead of calling balls and strikes to me.

Sounds to me like she just ruled the whole government shutdown unconstitutional.

Vindictive compliance is the answer. Just zero out the budget for federal district courts operations and salaries and apply it to the SNAP payments instead.

So much this... why not issue a court order forcing senators back to work? They are getting paid....

Too bad this judge was not around in the 1850's, early 1860's. We could have avoided a whole war if a judge had just told Lincoln that his actions were intruding on the sovereignty of the confederate states.

That declaration is awesome. Basically, the administration says, "sure, we'll deplete the SNAP contingency fund so La'Trasha can get some of her November benefits. But it might take weeks to months to make that work. But to hell with you if you think we're taking funds from WIC for that nonsense."

Very comprehensive way of telling the judge that his problem is with Congress, not the Trump administration. Boo effing hoo.
