Trump is considering declaring a national emergency to federalize the elections. I'm not a big fan of this idea but it would immediately be very tough for a judge to over-rule such a theoretical presidential determination.

I think it is way too late to do anything about the 2026 election, and this seems really heavy handed anyway. Not really a fan, UNLESS they can prove to the American public that something really fishy is going on beforehand. Which has not happened.

But Obama-judge Talwani is fighting the good fight for voter fraud.

Because of that, the Plaintiffs before her could not show "irreparable harm" -- Judge Sullivan's order prevented that. But she said if something happened to Judge Sullivan's order, the Plaintiffs could return and ask again.

The D.C. Circuit granted a Stay on Sullivan's Order.

So the plaintiffs in the League case filed a second motion for Prelim Injunction.

That is what she granted this morning.

The big difference is her findings in the first case only applied to the 23 States who were plaintiffs -- she had no jurisdiction to provide a remedy for States that did not join the suit and ask for such.

So that left 22 states where the Trump Admin. could move forward with EO 14,399.

Her injunction this morning is now nationwide.

I'm not aware of any ruling on this subject from the Fifth Circuit.

That's a great question. She has had time to read the briefs and stay the injunction, of course, but this is par for the course for her; delay out of political interest.

And they could wind up owing up to $1.8 billion, which if they are forced to pay back for the fraudulent billing will result in layoffs/closures etc. that will save many thousands of lives.

This is hardly over though. They were just trying to get out of an interlocutory order. The legal posture is what I would call 'in progress,' so I think some of the big tap dancing about the win is over-done.

Well, the 3 plaintiffs were deported already under INA, not AEA, so there really was no (AEA-related) dispute for the court to weigh at this point.


Pretty ridiculous, but we are eventually going to just have to hold our breath and see how ACB feels her way through this matter/issue.

It worked for me, though one has to open it in X I think? The crux of the piece is this; Talwani sucks, and he hints strongly that she is going to yet again lose her lawfare battle against Trump.

A Clinton judge who has quite a history of bias/failures from the bench:

In 2021, he was the judge in a case involving removing homeless people from Echo Park, Los Angeles. On April 21, 2021, Carter ruled in a 110-page opinion brief that homeless people on Skid Row, in Los Angeles, must be offered housing by October 18. Both the city and county of Los Angeles appealed, and Carter's ruling was overturned on September 23, 2021, by a unanimous vote of the 9th Circuit Court of Appeals.
