No, I am saying that we should want the best and brightest but we also need major reforms. A big problem is Universities. Another is the H1 lottery. Another is we are ignoring the fact that India and China make up most of the visas. Another is consulting firms that abuse the crap out of the system. One thing Vivek doesn't mention is Asians have become very adept at gaming the system. There are some incredibly talented people from Asia but it's gotten way out of balance.

I'd rather we not overreact but that may be inevitable. Another issue btw is we have made it increasingly difficult for white males to get into good engineering schools. Just a lot of issues have been ignored for too long.

Yep, see Barry Stanton. They exploit the algorithm with mass reporting to automatically ban anyone who disagrees with them even if they person has done nothing wrong.

Since it's impossible to compete with 1.4 billion Indians in situations like this, you're basically SOL with that account.

O-1's are very rare and really only for people with PhDs, multiple patents, and that have done a lot of speaking engagements. They are also very random. I've seen people denied for O-1 that seemed perfect and people get them that I scratch my head.

As to the larger thread you seem to want it both ways. Do you want to greatly limit H-1s or do you want to prevent offshoring? Can't have both, they work in opposition to each other.

I think there is rampant abuse in the H-1 system but overall it's a good concept. It needs to be much more limited and they need to crack down hard on the consulting firms like Tata and Cognizant that abuse the hell out of it. It should be merit based and not a lottery (that has never made sense to me). It needs to be more balanced as we have far too many from India and China as well as a few other countries. Those countries produce some amazing talent but they need to be severely restricted.

There are other abuses. For instance my company has stopped recruiting from a Top 20 University because they have some great candidates but almost all of them can't get an Export License. Why? They are overwhelmingly Chinese citizens on visa. The real abuses happen at the Grad school level btw, the amount of grad school folks who are on visa is just insane in technical areas. The schools want them so they can charge full tuition and OOS for public schools and they gladly pay it.

Shutting it off entirely is not a rational response. Major reform is. This is a very different problem than illegal immigration. Still a very real problem but it needs to be addressed in a different way. We want the Elon Musk's and Sundar Pachai's and Lisa Su's and Satya Nadella's and Jensen Huang's to come here. None were born in the US and they lead Tesla, Google, AMD, Microsoft, and Nvidia just for starters. Now you could argue that we don't want all tech companies led by immigrants as well but we certainly want that level of talent here.

Also, in my experience in technical recruiting for 30 years I have seen very, very few instances where a company is paying less for talent because of H-1's. It absolutely happens but it is typically with the big consulting firms as mentioned before. Some of the packages I regularly pay out to H-1s are for massive amounts, especially in Silicon Valley.

We also believe in meritocracy, dealing in good faith, and do not like Nepotism in our culture. They are all about nepotism, cheating, lying (saw it first hand at A&M), and doing whatever it takes to get ahead. It's not about race, it's about their beliefs.

It's interesting to say the least that the H1-B visa concept is somehow being twisted into some sort of anti-Indian thing.

If we were really sourcing our people based on talent, which is what Elon has said, they wouldnt 70-80% be from India.

Some of the best engineers work in Europe, Japan, and Southeast Asia. Why only India?

It's not because they are the best, at all.

Sorry but America was founded as a Christian nation with Christian (not Judeo-Christian) values. We can tolerate, but not celebrate, other religions. Democracy only functions in homogeneous societies that believe in freedom and the pursuit of happiness, not slaving away away at Meta or JPMorgan. We should not be accepting any "cream of the crop" foreign labor unless they believe Jesus is mankind's Lord and savior.

Hey Stymied, just curious why you don't move to India if you think living in a majority white country is so bad? Notice how you don't ever see anyone clamoring to get into any other nations except those in Western Europe, North America, and Australia.

Also, go to Google Maps, put on a blindfold, click street view on any place in the Indian subcontinent, and tell me what you see.You'll likely see piles of trash and cows walking around in the city. Do you want this country to become an open-air toilet/landfill like there? No thanks. We have dirty enough cities here already.

Says who? Certainly flys in the face of the entire cultural melting pot argument that most would argue has made the USA unique. We are arguably one of the best examples of a democracy (though really a representative republic) and we have been far from a homogenous society when compared to most others in the world.
