Trump has also vowed to expand the death penalty to other crimes, including child rape, human trafficking, drug trafficking, and people who murder police.

In 2008, the Supreme Court declared the death penalty for child rapists unconstitutional when the child survives, the American Bar Journal reported Monday.

However, with Trump in the White House, a Republican majority in the Senate and conservatives holding a 6-3 advantage in the current Supreme Court, proponents are hopeful for a reversal.

"The Supreme Court has said the death penalty should only apply when the death of the victim is involved, but that is subject to change with the makeup of the current Supreme Court," Mangino told Fox News Digital.

Three of the four justices who dissented in the 2008 Kennedy v. Louisiana decision are still on the court Justices John Roberts, Clarence Thomas and Samuel Alito.

Let the individual states decide if they want to have the death penalty or not. and most states have opted out of it.

Trump should be focusing on bigger issues.

Agreed. Too many examples of shameless prosecutors hiding exculpatory evidence to get convictions. I know they weren't threatened with the DP, but the Duke Lacrosse fiasco is a great example of DAs not just hiding evidence but effectively altering it to win. Nifong didn't give a damn if 8 innocent young men's lives were ruined as long as he could pander to black voters and white libs.

I agree with the premise of not making it easy to put someone on death row. However, there are thousands of evil people behind bars that should not be allowed to live due to the heinous nature of their crimes or for the inability to change and be a productive member to society. The best thing for everyone is to rid them of this world and release the burden on they cause on law abiding tax-paying citizens of this country.

It's cheaper to house these people that it is to go through all of the appeals, etc.

I personally think they are plenty of people deserving of death, but I also don't think the government should get to make that decision.

Don't tell me about "a jury of peers" the prosecution gets whatever it wants .

From a monetary view, I have read where it is cheaper to give one a life sentience without parole than to put them on death roll where they can keep filing appeals at out expense.

Cost should not be a factor. The fault is with letting them sit on death row for 20 to 25 years which drives up the cost. Six months for an appeal is plenty. But we have way too many lazy ass judges, lazy ass prosecutors, and lazy ass lawyers.

I believe this thread addresses the imposition of the death penalty for federal crimes only. Trump has no constitutional jurisdiction in the imposition of the death penalty for stay crimes.

One aspect of capital punishment is it's meant as a deterrent; accordingly, in the cases of false rape allegations &/or malicious prosecution, the offenders of such should face severe & lengthy sentences if convicted. Perhaps such laws would help alleviate many of y'all's concerns over zealous prosecutors in relation to the death penalty.

I don't have a problem with a father killing a personal harming his children or invading his home. If he is within his rights I'm ok with that. I think that is just.

I don't think the GOVERNMENT should decide it's ok to kill its citizens. I think that is pretty simple. THE GOVERNMENT being the distinction.

Because I know you may be obtuse I will also say that the government does not get to kill a person if he inappropriately used force and killed someone while claiming he was using self defense or claiming inappropriately to be protecting his property or family.

A PERSON must use JUST FORCE when exercising that power. THE GOVERNMENT can never use it after the fact.

That's my take. We don't have to agree and that's ok.

I trust an individual because there is a consequence for bad application of lethal force. The government can use lethal force and not face a real consequence. That is a major difference.

It is the God mandated duty of government to implement Justice, up to and including the death penalty. Supporting the appropriate use of the death penalty is ABSOLUTELY a conservative viewpoint and value. The bar for it is very high. As it should be. Capital punishment is a justifiable form of punishment with reform isn't an option.
We don't have "Capital punishment" - we have years and years of appeals, highly paid lawyers, and "death penalty" inmates behind bars for decades. Cheaper to just keep them behind bars and less humane than even a quick execution. Prison is Hell on Earth and the death penalty is simply an early release for some.
