• Philadelphia District Attorney Larry Krasner revealed his lawsuit against Musk and the America PAC "triggered an avalanche of [social media] posts from Musk's followers," many of whom "made antisemitic attacks on Krasner."
• Krasner's lawsuit accuses Musk and the PAC of operating an illegal lottery and trying to influence voters in the presidential election between Kamala Harris and Donald Trump.

The attorney asked the judge for an order that "requires attendance of all of the parties, i.e., DA Krasner, a representative of America PAC and Mr. Musk."

Hours after that filing, the judge in the case moved up the hearing to Thursday morning.

"All parties must be present at the time of the hearing," the judge said in the order Wednesday.

They want to be able to plaster Elon in court all over the media.

For it to be a lottery per PA law you must have consideration which is usually cash but can really be anything of value. The DA is making the claim that your personal identifying information is the thing of value.

I think it falls under the definition of a sweepstakes which would also be illegal because their are daily and weekly limits on how much you can give away.

But those are both criminal offenses and he isn't being charged with a crime. He's being sued civilly for violating the PA unfair practices law. They are claiming in addition to running an illegal lottery he deceiving Philly residents into getting them to give up their personal information and registration status as well as not actually posting the full rules anywhere. That carries a penalty of $5K per violation. I'm guessing they are going to count every Philly resident that applied for the program as a violation.

He needs to be subpoenaed doesn't he. How can he be expected to appear if he hasn't been served proper notice.

He's been served. The suit was filed last week.

The legal definition of a lottery requires an exchange of consideration (i.e. monetary payment) for the opportunity to win a prize by chance selection.

A giveaway of a prize (money) without consideration does not meet the legal requirement of a lottery and is legal.

If the $1M giveaways had been illegal then there would have been a flurry of lawsuits and/or talking heads immediately screaming as such, but there's no legal grounds to claim it violates the law because it fails the basic tests and thus the best the DoJ and others can do is stomp their collective feet and make statements about how it "might" be illegal.

Pulling Musk into a courtroom with less than 24 hours notice is a stunt, arguably to inject a new headline into the news cycle to take away from the "garbage" gaffe.

2. You should check what the daily and weekly limits are for sweepstakes or giveaways in Pennsylvania.

The DOJ isn't concerned with state law but rather that the contest and money giveaways likely violate federal law which prohibits paying people to register to vote. That's why they sent him a letter warning him presumably to give him a chance to knock it off before they are forced to take action.

I'm going to guess if a dem billionaire was giving away money they're wouldn't be a hearing.

Dems/American communists ordinarily love three things: power, taxes, and flooding voter roles via gimmicks like motor voter/automatic voter registration (Because inflated voter roles make fraud easier, as with not requiring ID, unattended drop boxes, etc).

This lotto/giveaway produces more taxes and encourages people to register/vote, but they hate it because Elon is one of their two enemies now. Pretty obvious political motivation to go after Elon even though he is helping them toward one of their three big motivations/goals, but they must feel it's a threat to their power.

Elon countered the States nonsense and filled to have it moved to federal court and the DA trying to engineer this nonsense is butthurt. The DA legal counsel says they are going to go to the federal court to file to have it remanded back to the state court.

Aren't you Supposed to try to influence voters regarding certain candidates for an election? Isn't that the purpose of most election activities? Are they saying a PAC can't advocate for a candidate it views as better for its political interests?

Odds that they will now try to hold him in contempt and arrest him for not showing?

Granted I haven't read a whole lot on this, but my takeaway is that he is trying to get people to register to vote, not to vote specifically for any given candidate.

I don't know enough (or anything) about the PA lottery laws, but how is this different than any other PAC, well aside from the whole million dollar reward thing? I would think that Musk was smart enough to consult with his legal team about the legality of the whole process and that he will be well prepared for this court summons.
