Section 230 of the Communications Act of 1934 protects Meta and other platforms from being held liable for what people say on their websites/platforms. With that said, Meta, et al cannot determine what is and is not truthful information worth being shared, as this makes them a publisher, not merely a host site. If they are publishers and not merely hosts? They lose their protection from lawsuits over things said on their platforms.

The real issue is that it isn't just a single event that happened right before the election. Yes, the laptop was a single item, but the disinformation was going on prior to the 2016 election and is still continuing today. It is Google constantly pushing negative news with little positive, it was Twitter constantly blocking conservative voices, Meta blocking conservatives, YouTube still blocking out and demonetizing conservatives.
