This case was for sure. This judge, however, is a GOP friendly judge. DOJ was going to have to be perfect to get this past her, and obviously she took issue with how Smith was appointed to start with all of this.

If Judge Cannon dismisses the indictment because she finds Smith was unlawfully appointed, here’s what DOJ should do:
1) Don’t appeal
2) Have US Atty in FL refile the same charges in a new case - it would be very easy and fast
3) case gets reassigned- hopefully to a new judge 1/

4) Smith’s prosecution team are designated as Special AUSA’s in FL to continue prosecuting the case.

I can’t see any reason this wouldn’t work - it’s faster than an appeal and gives them a chance of drawing a new judge without having to argue for removing Cannon. 2/

That assumes that the feds will even attempt to appeal the decision. I have no idea what they will do since the D.C. case has a lot more uncertainty due to immunity issues that have been brought up.

Not yet. That case is on life support but not DOA.

Government officials of certain degrees of authority are required to be nominated by the president and approved by the senate. This would appear to include positions like flag officers in the military, and federal prosecutors.

Smith was appointed by the attorney general and never reviewed by the senate. There is some sort of special prosecutor federal statute but I am not sure how it comes into play, but I do know Justice Thomas explained a rationale that this appointment was unconstitutional.

There used to be a federal statute but it was sunsetted. DOJ adopted a rule on special counsels but that's just a rule not binding on federal courts.

Wouldn't it have to COMPLETELY start over? New FLORIDA grand jury? They already did a bunch of legal BS moving that case around.

Considering everything that has happened over the last few weeks, this case (and all the other case) is moot. Nothing will go to trial before the election regardless and Trump is likely to win (at least at this point).

And if he does win, everything goes away.

I suppose technically.they could start over with a Senate confirmed US Attorney and get a grand jury in Florida to reindict him but that would take a lot of time.

Step 1: Appoint biased judges who will bend over backwards to protect you.

Step 2: Commit crimes.

Step 3: Profit. In this case literally profit, off of stolen national secrets and security documents.
