But he will be. Justice denied.fc2112 said:
Case was not dismissed - just indefinitely postponed.
Which denies Trump the right of appeal.
He also now cannot be called a convicted felon - not convicted until sentenced.

Who is to say Judge Merchan will still be a judge in 4 years...will25u said:
Was listening to the lefty lawyer video I posted above. Not sure if anyone listened...
He laid out his three actions that could be taken by Judge Merchan.
1. Dismiss the care outright(he said not a chance).
2. Sentence Trump but stay the sentence and allow it to go to Appeals.
3. Postpone sentencing indefinitely and have it hovering over Trumps head while he is President and then schedule sentencing as soon as Trump is no longer President.(Most Likely, he thought)
So we may have our answer as to what Judge Merchan is doing.... Waiting until Trump is no longer President and then picking back up.
Justice delayed is justice denied. Merchan may be on the receiving end of service of process from a federal suit for denial of due process, denying Trump his right to appeal and have the case thrown out for myriad reversible errors.will25u said:

Here's the reminder that caused the confusion. The "hearing type" is listed as "adjournment," which Laura Loomer and several news outlets took to mean that the sentencing had been delayed. But that just means the hearing was adjourned *to* Nov. 26 (from previous date, Sept. 6) pic.twitter.com/0pk3voeL3c

The Manhattan DAâs Office has recommended to Judge Merchan that he delay Trumpâs sentencing to allow for the Court to address Trumpâs motion to dismiss (if the Court allows him to file it), and the DAâs Office will file its opposition to the dismissal of the case no⌠https://t.co/9cJGmZmcns

Let me explain to you what is never going to happen: Trump going behind bars.

You were DEAD WRONG about Trump going to jail. This is more like someone predicting Texas A&M would lose to New Mexico State and then being mad someone mentioned it!Quote:
Way to refresh a halftime post in a game thread AFTER the game is over.
This sounds like it is potentially harming the rights of the accused.Im Gipper said:
Technically, it's on hold forever until a judge decides it's not on hold. If merchant retires, a new judge will be in his seat. That person takes over.
But the order appears to Indicate Nov 19 is when the state has to say what it plans to do.
The expectation is that New York is going to drop this case. At least that's what they should do. They are taking this time to review the implications of Trump being president elect.
Remember, Trump has not been convicted of anything.
It for sure will be at some point.Quote:

Since when has a judge ever been forced to do something one party has requested? Or even both parties have requested?Im Gipper said:It for sure will be at some point.Quote:

As of today, Trump wants Merchan to hold off on making a ruling.
That is true! Merchan can rule whenever he wants.Quote:

Merchan is not bound to honor any requests if he doesn't want to. Hell, he doesn't even have to rule on each and every defense motion and has not ruled.
So now YOU'RE predicting he goes to jail?Im Gipper said:Quote:

Good grief.Quote:
While Manhattan District Attorney Alvin Bragg's office subsequently told Fox News that was an automated schedule alert rather than a formal action by Merchan, Bragg's office has now filed a letter with the court requesting that the case be formally adjourned to allow time for Trump's legal team to file an additional motion to dismiss based on the unique circumstances in play given Trump's reelection and impending inauguration.
Bragg's office intends to oppose that motion but is asking the court to set a motion schedule to accommodate the filing of the motion and the prosecution's response. As of this writing, Merchan has not ruled on the prosecution's request, but presumably, the request will be granted. We will continue to monitor and provide an update as soon as one becomes available.
Oh, just in case you missed it Trump is STILL not a felon.

He was never sentenced.
It was ALWAYS a political hit job.

And what is the prosecution's reason for wanting the delay? They know their case will be tossed if Trump is allowed to appeal?
