The decision that Colorado can't use Section 3 to keep a federal candidate off the ballot was unanimous. Barrett, Kagan, Sotomayor, and Jackson concurred in that decision only, because they felt the court goes too far in deciding exactly how the government should handle that situation if it ever comes up because in their view, that question wasn't before them.
And there's likely to be a sticky situation if that ever occurs, because if you read Section 3 the way the majority reads it, Congress could enact a law that a specific someone is not eligible, but a 2/3rds majority by a later Congress could remove that disability. That seems at odds.

It means that every state with a conservative legislature would retaliate by removing Biden from their ballot under the auspices of the 25th Amendment, or maybe on the grounds of treason since he isn't enforcing current border laws. That's my guess.

The idea that these judges actually work hard to interpret the laws instead of starting with a preconceived bias all the time seems ludicrous to both sides.
We love this decisions but want Abbott to ignore their ruling. When states start down that road, it will get easier and easier to just ignore SCOTUS decisions if they are in opposition to what the states want to do, even if its against the federal constitution.

I said a very long time ago that the 14th argument was not legally viable. It was a dumb argument to begin with.
That is not the same thing as saying that SCOTUS would agree in an unanimous decision however. The fact that it ended up as unanimous, although by different paths. And it was all of those different paths that prove it was not viable. Too many off ramps.

Geezus people this was a layup for the SCOTUS. The constitution is specific about it. States are NOT empowered to enforce the 14th WHATSOEVER. Hawg and BMX have been saying this from the beginning.
