Are you serious? His entire business model is set up to bypass the FDA and state food safety regulators.

The FDA is thuper important.

They make sure companies don't make "vaccines"* that rape our immune systems for things that are 99.9+ % survivable by just existing.

A month ago, a federal judge appointed an expert to work with Upper Leacock farmer Amos Miller to make sure he complied with food safety laws and court orders...

Three times, the expert visited Miller's Organic Farm, but he never was able to inspect it, despite a court order.

The first time...(the inspector) said an employee told him Miller wasn't there and refused him entrance. Even so, he said he was able to see workers packaging meat and poultry, which isn't permitted until Miller is in compliance.

On a March 4 visit, Lapsley said Miller handed him a note that read, "What are the compelling public interests to be here? Please respond by paper."...

And so on Wednesday afternoon Miller...dialed in to a status conference call with the judge for a course-correction....

Miller tried to ask the judge if he read a recent filing he made. The largely unintelligible filing espoused "sovereign citizen" rhetoric.

Miller's attorney, Steven Lafuente, of Dallas, Texas, said he was "at my wits' end" trying to reason with Miller.

Note: Lafuente is no longer representing MIller

Miller's first came to the attention of federal authorities in 2016, when the Food and Drug Administration said it identified Listeria in samples of Miller's raw milk; the agency found the Listeria to be genetically similar to the bacteria found in two people who developed listeriosis one of whom died after consuming raw milk.

You crack me up.

You post this Tweet from Miller's lawyer, and apparently believe the lawyer's bullcrap.

Miller won nothing.

The judge ruled that the lawsuit by the State of Pennsylvania can continue. Loss for Miller

He did remove the restriction on selling across state lines. That's only fair, because the lawsuit is by the State of PA and is in regard to PA laws.

But I don't see how you can call it a win for Miller. The Feds still require milk products in Interstate commerce to be Pasteurized. Miller doesn't Pasteurize, and is under a detaining order from the USDA that he can't sell Interstate.

For anyone interested in the actual ruling, not the lawyer's fantasy:

A Lancaster County judge won't dismiss the Pennsylvania Department of Agriculture's lawsuit against Upper Leacock farmer Amos Miller over his raw milk sales.

Lancaster County Judge Thomas Sponaugle's two brief orders issued Tuesday also modified an earlier order that had prevented all sales so that it specifically applies to sales in Pennsylvania.

That would seem to allow Miller to sell raw milk and its products to customers in other states, although federal law requires that milk shipped between states be pasteurized. Miller's ability to fulfill out-of-state orders could be limited given the detaining order placed on his products earlier this year by the agriculture department.

Miller has been the subject of federal and state efforts to compel him to follow food safety rules.
In January, state agriculture inspectors raided his farm, prompted by two illnesses late last year in New York and in Michigan traced to his raw eggnog. The department then sued him Jan. 23 because he doesn't have a permit to sell raw milk and hasn't registered his business with the state, among other alleged violations.

Sponaugle's orders pave the way for the suit to continue.

Sponaugle gave Miller 20 days to respond to the issues the agriculture department raised in its Jan. 23 suit.

Miller's attorney, Robert E. Barnes, said in an emailed statement Tuesday night, "The judge's order is a major relief to Amos Miller & all of his members. As hundreds of out of state members testified to the court, they need access to Amos Miller's milk products for their health & their loved ones."

Ahead of a February 29 court hearing on a request by the agriculture department to prevent Miller from selling goods while its lawsuit plays out, more than 350 people wrote declarations to the court saying how important Miller's products are to them or their family members. And at the hearing, several people testified to that point.

In asking Sponaugle to modify his order to allow sales in other states earlier this month, Miller's attorneys wrote that Miller faced "substantial irreparable injury" if he couldn't sell to out-of-state customers and those customers "will suffer substantial harm if not afforded access to these products."

As for the federal government's pasteurization requirement for interstate sales, Barnes previously told LNP that the federal Food and Drug Administration has agreed not to enforce the rule because it's being challenged in the courts.

In the orders issued Tuesday, Sponaugle also granted a request from Miller's attorneys to order the owner of the website millersorganicfarm.com to stop marketing Miller's products.

Though attorneys for the agriculture department had contended earlier this year that Miller was responsible for the site, Miller's attorney said Miller doesn't have anything to do with it. Barnes said the woman who owns the website has been told for more than a year to stop marketing under Miller's name.

Sorry Charlie this report of Listeria was proven 100% false in court.

Miller's had leased cooler space to a local farmer and it was one container that test for a "trace" of Listeria. That Milk was not being sold, only being stored.

Swing and a miss.

I just did and the proof was posted weeks ago.

Common sense, and please forgive me for mistaking you as such, would tell you if the FDA had actually found Listeria in Miller's products, would he be free to sell outside the state of FA which falls under the FDA authority. The court ruled today that the PDA has to stay in their own lane and they had no authority outside the state of PA. The PDA's complaint had NOTHING to do with contamination, only proper licensing/permits. Miller is fighting that claim still. The FDA has no complaint in this cause.

You can connect the dots if you wish.

Yes. The judge ruled that the state of PA has no authority on interstate sales

But the federal FDA still has a consent order with Miller, and they still require Pasteurization.

It's not an ad hominem, that would be how you have been responding to me this entire thread. I simply noted the attitude you constantly show

We have lots of Amish around us and do lots of business with them. Lots of their barns and buildings are built with cender block and wood frames and then they use metal siding and roofs.
Just because they are Amish does not mean they can't use metal and steel for buildings. Hollywood would have us believe they all live like they did in that Harrison Ford movie "Witness"….. but that's not how they all live.
It depends on what Amish church they belong to as to what they can have and use. Some allow tractors… others do not.

Health officials say a deadly outbreak of listeria has been linked to raw milk from an organic farm in Pennsylvania.

The illnesses happened in 2014 but it took investigators until now to determine the cause. Two patients got sick from the bacteria, one in California and one in Florida, and the patient in Florida died.

The U.S. Centers for Disease Control and Prevention reported Friday that the outbreak had been traced to unpasteurized raw milk produced by Miller's Organic Farm in Bird-In-Hand, Pennsylvania.

In January, the FDA found listeria in samples of raw chocolate milk produced by the same company, and said genetic testing confirmed it was closely related to the strain that sent the two patients to the hospital in 2014.

The Ag Department and Attorney General's Office sued Miller in January to stop him from producing raw milk products without state-required permits. The state acted after a person in New York and another in Michigan were sickened by E. coli and reported having consumed products from Miller.
