I always carry my valid TX DL and my Passport card in my wallet along with my CCs.

Why is this so difficult for others?

Remember the old AmEx commercials...Don't leave home without it.
Not everyone has a DL. Not everyone even owns a car.

Oh look, more of that racist bull**** claiming that minorities are too stupid to obtain a legal form of identification.

They're not too stupid, there's just some who don't own vehicles so they don't ever get a driver's license.

They're still required to identify themselves upon arrest.

Every state has a non-DL id card.

Racist? Which race are we talking about?
Is the statute facially "racist?" Of course not.

But even Pollyanna can anticipate (correctly) that it will be applied in a racially (or at least "ethnically") discriminatory manner.

Racially-neutral, correct, factual observation, and the response infers racism?

Sounds lilke a Dem response.

There's this thing called a state ID.

Good law.

If they are here legally, they do not have to go back to Mexico. They can be arrested and make their case as to why they should not be deported.
Except that is not what the bill SAYS.

Barney Fife can unilaterally haul some random person to Brownsville, tell the to go to Matamoros and just dump them f they don't cross the border. That person does NOT get the chance to "make (his) case as to why (he) should not be deported." All of this is at Barney's OPTION without any judicial involvement at all.
Quote:

Penal Code 51.01(e)

A peace officer may, in lieu of arrest, remove a person detained for a violation of this section by:

(1) collecting any identifying information the person may have;

(2) transporting the person to a port of entry; and

(3) ordering the person to return to the foreign nation from which the person entered or attempted to enter.

It looks like at the officer's option he could transport the person to the Canadian border instead of the Mexican one if it caught his fancy.

If they're not Mexican or Canadian it doesn't matter, just command them to return from whence they came.

Hilariously bad law. Stop them at the border rather than doing away with due process based on individual cops' whims.

I'm not seeing anything in the enrolled version of that bill that is of concern. Just seems to focus on the illegal presence or illegal entry. much of the initial language from the original text posted on this thread has seemed to change although i cannot see it in the amendment history.

Unless someone is detained or questioned for another purpose, then i don't see an avenue for someone to be questioned about their citizenship and the hurdles of the 4th amendment. Now **** up on something else then you have problems if you can't prove your citizenship.

I'd much rather see Texas make a law that pending federal asylum claims will no longer be recognized as legal papers.

Sure, it'd suck to be a legit asylum seeker caught in the cross fire - but there are 49 other states where they could go to to work, rent, buy, live, etc.

No, he's saying there's a bunch of US citizens who don't (The Wife's grandmother was one) and a bunch of non citizens who may well speak, read, and write it better than you.

What probable cause do you have that gives you a reason to demand my ID?

I'm brown and speaking spanish is not allowed to be used.

sounds great, until someone hispanic you know is taken to Mexico just because they didn't have their ID with them.
there are many ways to validate your identity and prove who you are if you forget to take an ID. In any event, this is a weak argument. Do better.
If you don't have probable cause, I don't have to show you my ID.

And a tad racist. And without due process seems unconstitutional. Does this mean I can be pulled over to prove I'm a citizen? Or will I have to be committing another crime first?

I don't have a problem with the idea of verifying citizenship, but I imagine the courts will make some rulings that may require the application of this to be slightly tweaked so we don't have American citizens of hispanic ethnicity taken to the border if they don't have their DL.
I'm a ginger...so it doesn't affect me.
