Depends on the venue. If tried in the federal district that includes Chappaqua where the server was located, she could have easily been convicted. A DC jury? Doubtful she would have been convicted there.

Saw that in the Ted Stevens case. Venue should have been in Alaska since most if not all of the allegations happened there. But instead it was tried in DC.

So, we have Trump on tape supposedly talking about "classified" documents.

A few questions...

a) Do prosecutors have to prove that he actually had a classified document and if so, which one?
b) Given Trump's proclivity for bull****ting and exaggeration, would a defense of "he was full of **** and just bragging and the document wasn't classified" be possible? Especially if they can't identify the exact document he was supposedly referring to...

That 76yo Trump, who the left has always quipped is overweight, not fit, can barely walk down a ramp is the one who moved countless boxes from the White House.

Boxes he packed himself during the same time period he was plotting to overthrow the government, then ran back over to the White House and is on camera stuffing all these boxes onto Marine Once for a hop to Andrews where he is again shown to load the boxes into the belly of AF1 on Jan 21, 2021 and then in Florida loaded the boxes into the motorcade for transfer to his personal residence, where he knowingly stuffed the boxes into a bathroom, locked storage closet, unused auditorium, etc.

Nevermind that the personal residence and private areas of where these documents were stored were guarded by Secret Service detail and 24/7 recorded CCTV surveillance.

Important to note that the indictment presents a one-sided account of the prosecutors best case. From that point forward, the case is only weakened as more evidence is produced by the defense and legal arguments are made for defense.

There is a BIG reason the PRA is not referenced in the indictment. Smith knows it can blow a huge hole in the case. It quite likely makes all the evidence they have fruit of the poisonous tree from the illegal raid and the illegal seizure of attorney-client communications.

Who says they weren't? Obama is still arguing these things over his documents. W fought information releases for YEARS and I believe there is still ongoing decisions regarding documents, particularly related to 09/11 and Iraq / Afghan wars.

NARA was instructed by WH counsel to go involve the DOJ, which was highly inappropriate and likely not legal.

You do not argue such things at this level. This isn't suing someone for you neighbors dog peeing on your roses.

I would not bet on that. I think this winds up at SCOTUS way before an actual trial. Again, there are essentially conflicting laws / acts that apply and that SHOULD be sorted before any trial.

Alleged is missing from all your accusations. Discussing with your attorney what is legal v illegal is not the same as instructing your attorney to commit illegal acts.

I am not answering the last question. What I discuss with my attorneys is "privileged and confidential" a concept protected by laws and years upon years of judicial precedent.
