Because of the grand jury indictment, today will be before a new judge, not the Magistrate that entered the gag order.

ETA: proceedings will be recorded by not lve streamed. Recording will be released after conclusion of the hearings.

Now discussing he is not waiving right to speedy trial, counsel asks Judge Judge to set the trial at the end of the six month period and expects the trial to last 4-6 weeks. October 2nd is the tentative date.

But the prosecution is fully agreeable to that time frame but defense still could ask for a continuance later and waive speedy trial.

Arraignment done.

Death penalty still on the table for the next 60 days. So prosecutors have until that time to meet further with the families and community leaders before they decide.

It can be a combination of rationales but under the law, standing silent is taken as a plea of not guilty. There is no requirement for the defendant to say anything other than if they understand the charges against them.

Family members of the victims were in the courtroom, so his saying aloud, "Not guilty," might upset them and his PD recommended he just stand and let the judge enter the plea into the record.

As a practical matter, there is no plea deal until the death penalty issue is resolved. Defense has little incentive until that decision is made. Again, there are families here. And they might not all agree to taking death off of the table. Prosecutors have to be mindful of that and defense counsel (who are certified DP lawyers) know that too.

Further, the prosecution very recently did a massive data dump as per their discovery obligations. So his defense team will have to go through all of that before advising their client on that issue.

Anyone expecting the possibility of a plea deal this early is not being realistic given the complexity of a multiple homicide with stalking implications. (An aggravating circumstance in terms of sentencing.)

Nancy Grace reported on FNC this morning there is another case involving BK and stalking behavior. He had a female friend whose apartment he went in secretly and rearranged things to freak her out. Then he kept questioning her until she told him about it. Then he offered to put security/surveillance system in her apartment. Which he of course had remote access to so he could watch her in her own apartment. That may or may not play into this case but it shows propensity and then he was not just a fledgling killer. He planned in advance.

I forget exactly how much was contained in the recent discovery dump but it was well into terrabytes. So maybe he had been stalking others too?

From the evidence I have seen - it looks pretty overwhelming. The only concern I have it is in Latah County which is a slightly blue county in Idaho.

ETA: To be clear, that is from a jury selection standpoint, that is a sticky issue.

On the Dateline episode on Friday, there was also an instance where a girl's suitcase was rifled thru in her car and her panties were stuffed in the cupholder. Tho I think this happened in March 2022, which would have been before BK got to Washington. That was creepy too.

In a case as complicated as this one, a speedy trialcould work to the defendant's benefit with a small prosecutorial team in a small county in a sparsely populated state. So it really depends on where the case is brought and the resources the state and local officials can throw to it.

Damn near worked in the Alex Murdaugh trial but the state AG was all in on that one.
