That doesnt seem uncommon for college kids to get food delivery at 4am after a night out lol. She probably ordered it at 3am and it took an hour or so to get there.

People aren't as observant as we would like them to be all the time. Include poor lighting, booze, surprise, etc and you get seemingly odd results. I have randomly been able to recall license plate numbers in the past but couldn't tell you the make or color of a car. My flashbulb memory grabbed something but not everything from a moment. It happens.
She heard Kaylee say "theres someone here", then heard one of the roommates cry/whimper after opening her door two separate times, then sees a strange man (BK) walk out dressed in all black, and is frozen in shock after that.

Sounds like she was pretty coherent recalling those details/timelines and the majority of people would have called the cops or checked on their friends.

Regardless of plates, they are going to identify the car. It's going to be attached to you if you rented it. I bet every rental company has cameras at the front desk, so you'd be a sitting duck when you returned it.

Hiking in... ok, but that just leaves you on the cameras even longer, and that's even more incriminating.

I think the best bet is not to plot to kill anyone. Odds of avoiding the death penalty are pretty good with that.

She had a very good memory of the details/timeline from that night. I dont think she was that drunk.

By reading very fact based statements in the affidavit it sounds like she had a very good memory. We don't know how the interview actually went.

Also, something to consider for basically everyone my age (35) and younger...many people who live in shared apartments/homes throw their headphones on once they retire to their room. This could explain why people weren't hearing a guy moving around the house, or the faint sound of crying, then you take an earbud out and hear someone say it'll be ok, etc.

We dont know if the killer saw DT as she opened her door and observed him walking toward her just before he left through the sliding door.

It's plausible he didn't see her. He just brutally attacked 4 people, he was likely exhausted, had an elevated heart rate, full of adrenaline, and he was wearing a covid style mask (was he also wearing a hoodie?)., which may have become disheveled during the attacks and partially obstructing his view. Additionally it was very dark and there were cries and moans… so it's not like it was complete silence as DT opened her door.

I assumed DT didn't think he saw her. That's why she closed her door and didn't call anyone (didn't want to make a sound and alert the killer she was in there ).

I asked my wife what she would do. After reading the affidavit and looking at the maze like floor plan, no where to escape in DTs room, she mentioned she wouldve remained quiet , tried to quietly find something in the room to protect herself and place her back on the wall where she could see both the door and window in the room, while praying silently,

I then asked my wife if she would text anyone? She responded that he may have the roommates phones as a momento or picked them up so they could not alert authorities before they died; giving him longer to escape. She mentioned she wouldn't text anyone in the house . She would probably be frozen in place (and most others wouldn't get the text at 4:30 am until hours later).

I could see DT doing something similar and finally falling asleep from exhaustion on the floor of her room.

Yeah, I would not rent a car. Even if using fake documents, I would bet you are on camera. Might think about stealing a car, one that would not immediately be reported as missing (peruse social media for people going on vacation and leaving a car or two behind). Have a bicycle in the trunk and stay a few miles away from the crime scene. But yeah, I agree with your best bet.

Some rental cars have a gps fleet tracking services to account for mileage and whereabouts (particularly if they are near the border).

A rental car may just show exactly where you and where you have been.

Best bet would be to use old license plates from another vehicle

Now the authorities have access to his computers and other electronic devices. If he was following them on social media, instagram and the like and if he interracted with them.

They also will be able to find out if he was that reddit poster.

I think the point would be that if you took off the plates on a rental

no one knows you were in the car

the entire reason the police caught this murderer was because the Elantra was spotted on video so many times

so all they had to do was find who owned an Elantra at it's final location (Pullman). which literally led the police right to Kohberger.

use a rental, the police don't know it's a rental, where it is from, or who was renting it.

doesn't it seem like most of the testimony is from DM Dylan about what was happening, and that she saw Kohberg exiting

where is the testimony from the other surviving roommate? she didn't hear or see anything the entire night?

Maybe.

Cops just put barely enough facts on affidavit to get a warrant. They have tons more evidence but won't show it yet.

I am with you, but one of my roommates (now a well-respected MD in Austin) was an exceptionally hairy guy and always left our bathtub and bathroom pretty much covered in hair. Didn't even matter if the room was otherwise clean or clutter-free. There was really nothing I could do about it, short of carrying around a Dustbuster behind him.

But yes, that sink area is nasty.

Thank you all for such a fascinating discussion. Just keep in mind that the affidavit contained sufficient evidence for an arrest, not particularly all the evidence they have.

Yes. I can guarantee that drafts of that declaration went through layers and layers of attorneys, including former judges, to strike just the right balance between revealing no more than they have to, but still providing enough for a warrant.

9am would've had enough sun light to illuminate the kitchen by DMs room through the windows and glass sliding door. The sunlight would have given her more details of the suspect. Besides she said she heard cries and activity, which prompted her to open the door to investigate. Surely the victims didn't linger in excruciating pain and agony for 4&1/2 hours before they expired (God I hope not).

IMO, he was likely restless and got up and drove back to house to see if the crime was discovered. Perhaps I'm wrong, but it would be too risky, even for this creep, to go into the scene, look for a sheath and walk out w it in broad day light
Ah, I may have misinterpreted there. I thought she saw him in the 4am hour as he was leaving the scene? sorry, been crazy busy at work today so a bit scattered

Yeah, the massive proliferation of cameras in urban settings has changed things a lot. Options would be stealing a car or doing it at a time when you could blend in to other movement, which brings tons of risk of its own.

I shared an apartment one summer in Cstat with two of my girl friends. I thought it was going to be great; that they would cook and the place would be neat and smell good because, well, they're girls and they always look neat, smell good, and got-it-together. Turned out that they were both filthy pigs who were both on diets and made "diet" shakes in the blender and would add ice cream to them. They would wash and dry ONE blouse or a pair of jeans or other article of clothing because that's what they wanted to wear that night. Our utility bill was through the roof! That experience may be why I waited so long to marry. But I digress...

The knife sheath (with BK's DNA) seems to be the key piece of evidence. How does the PD discredit it, or does she try to get the judge to throw it out on a technicality?
