This is a really weird filing. It will probably be rejected. It also appears to be a publicity stunt and the lawyers will likely be sanctioned.

Unless this is some bizzarro criminal rule (Aggiehawg bat signal), you don't start a new case with a "motion" and he's what, filing it "In Re" the Mar-a-Lago search, so he served it on nobody? They are seeking an ex parte order against the government? Really, really weird. How does it give the Court jurisdiction?

Yes, it is out of the ordinary. Appears to me that the working theory here is that DOJ was less than honest with the Magistrate about the amount of cooperation Trump and his lawyers were extending to DOJ and NARA. Access to facilities and even his employees at MaL.

But the request for the appointment for a Special Master under the circumstances is legit.

Why the choice of venue? SD of Fla?

Did they serve the suit on anyone? What court is going to issue an ex parte order on the DOJ? This should be styled a Motion for a Emergency Preliminary Injunction if it is ex parte. They also have to brief the court on how they meet the standard.

I file motions for protective orders as original proceedings all the time under TRCP 176.6(e). I don't practice much in federal court, but there could be some similar rule.

The request could be moot by this point if the FBI has completed their review. This is why I'm stumped as to why they waited two weeks to file this. Seems like something that should have been filed the next day.

Procedure is everything in Federal courts. For example, I'm not even sure this is front of the correct judge. The clerk even noted that Reinhart is able to address this if the parties agree.

The judge, magistrate, should have never, ever approved this raid. This particular judge was shopped by the JD knowing he hated Trump. Now , with that how can we ever trust the judicial system?

This is a donkey show out the gate. Get what you can on file. The circuit court is gonna have to sort this out one day and you want to build in every single off ramp you possibly can, right off the bat. Somebody is out there thinking this through. You can't "get [your arguments] on file" if you're not filing said arguments correctly. This is real life, and real federal court procedure, not a TV show.

There is nothing conventional about any of this. Beyond the fact that the raid and investigation are completely unprecedented the fact they did this raid with an incredibly broad scope was odd. Raids like that are supposed to come at the end of an investigation when they have the goods. This was a "here is the target, let's find a crime" raid which is wrong on every level.

Of course the real problem is that we are in Banana Republic territory all around. The law doesn't matter. You have the DOJ acting as a wing of the WH doing everything they can to find a crime for political purposes. They are picking judges that are allies and they will do everything in 90% Dem DC for all court proceedings.

It's all a show.

Maybe piss off the Magistrate that DOJ lied to him? Get the issue before him?

I'm not really sure other than the Special Master and wanting a more specific property receipts for what was seized. But as other posters have pointed out, that should have been done sooner.

DOJ has to know any indictment brought on the basis of the seized materials will be attacked for being an invalid search and fruit of the poisonous tree.
