there is already a federal suit saying not requiring mask violates ADA because of the weak lung kids in school. pretty frivolous argument.

The Texas Supreme Court is the final word on this particular case. it is not a federal court issue.

The sad thing is that the right judge can make anything a federal issue.

Richardson ISD just announced they are officially joining the La Joya ISD lawsuit out of Travis County.

Quote:

The lawsuit, initially filed by La Joya ISD in the 353rd Judicial District Court, currently includes a number of other Texas school districts joining with LISD.
Any idea on where this is in the appeals process? I can't find anything.

Edited.... Found it. Looks like the hearing was yesterday and the TRO was issued/confirmed? Assuming this goes to the 3rd court of appeals then to the supreme court?

It would be difficult to have two school districts that are more unalike join up on something.

If this doesn't confirm the industry and or group collusion on things I don't know what would. The bulk of the Schools want the panic, disruption, and fear to continue. La Joya cancelled all their extra curricular activities last fall and were one of the poorest districts in terms of virtual and online schooling. I heard some wild things, bordering on illegal about the hijinks there. La Joya might be unequaled in corruption, at all levels, in the State of Texas. And they are gonna do all possible to keep kids out and away from school while getting as much money as they can.

Such a dangerous, slippery slope we are going down to potentially masking forever in some instances. You can always use the disabled child can't get vaccinated argument.

The RISD super is headed for a mine field when they lose this suit and taxpayer money is wasted.

I will be pushing for her termination.

The Board voted 5-2 to support it. Need to email them now and push for change there.

These decisions need to have consequences.

I have been corresponding back and forth with Karen Clardy and the only thing I'll give her credit for is actually consistently communicating with me.
Other than that she is obviously straight up lying to me on the reasons RISD is doing this and trying to pretend like they are not taking a hard stance on this. They tried to hind behind the county order at first, then she said they needed this extra time to vaccinate teachers and now the excuse is this is about local control in general not masks.

Then she claims to me "I'm actually really conservative."

Yep. Just need two to flip the board. Would probably help with CRT and other liberal agendas.

Believe me, I am way ahead of that.

Karen is being manipulated by the Superintendent.

Weird dynamic there where Karen was an office admin and craves superintendent approval.

Nothing on the docket in the Bexar county case even though justices said to file response by noon today. Might just take some time to get through docketing.

Damn shame. If only they'd had, oh I don't know, like a three month window where most of them had nothing else to do.

I've told people in the past, I don't really care if you want to talk **** about me, or A&M, or whatever, just don't suck at it. I'm slowly reaching the same point with lying.

Not anything related to this mask deal. When the LJ district shut down last year, they were in no way prepared for going online and there were all kinds issues with IT and computers and what not. Also the word was that their meals to go program was rife with all kinds corruption and that food was being siphoned off in industrial quantities. Teaches and all kinds of folks were paid full salaries, many for things that had been cancelled. Just your typical run of the mill corruption deal in a South Texas small town.

You can google search La Joya ISD corruption and you will get all kinds of interesting links. School board elections in La Joya are tantamount to a full blown Mexican political campaign it is serious stuff.

If you really want some interesting reading, google Rio Grande City ISD employee murders. Two RGC-ISD employees were executed, both women and one was high up in the finance area, a few years ago. Never solved and all kinds of rumors.

Sure wish Abbott would get this cleared up. Locally no issue for me, but i have to attend an event in another district and they are telling our district ahead of time, you have to wear mask at their building. I would cause a stink if it didn't involve my kids event.

Your kids don't have to wear masks in your district, but they have an event in another district that is requiring them to wear masks and you don't want to raise a stink?

I surely hope I read it won't because I would be raising hell if they tried to muzzle my kids and certainly would not comply.

Reply Brief is last thing filed. It means Paxton didn't wait to file it, he got it done within hours. So should get ruling before the weekend. My WAG is tomorrow at lunch

Abbot filed a brief explaining what the SCOT should side with the governor.
Other side filed a response brief explaining why Abbot is wrong and the SCOT should side with them.
Abbot filed a reply brief explaining why the response brief is wrong.

There should be nothing further filed by the parties. At this point, the SCOT can decide the case on the briefs, or set the case for oral argument and then decide it after the argument. Given the time-sensitive nature of all this, I'd expect the SCOT to decide on the briefs.

Or just this one specific one?

My guess is the Supreme Court could clarify in a decision that all government entities are covered rendering any other case moot

I've not followed this case very closely, but it just covers the specific orders presented to the SCOT in this proceeding, which are the San Antonio / Bexar County orders. Because the court will presumably rule the same way in the other cases involving other local jurisdictions and ISDs trying to impose mask mandates, this case has become the bell cow on the issue. This case should tell everyone the answer for the other cases.

But they can't enforce their illegal laws. Especially if they are going directly against a SC ruling. In the end the tax payers will shell out after people sue when these local tyrants infringe upon their rights. Jenkins and his ilk DGAF about the taxpayers, the constituents, or the areas they govern. You and I are to be used as means to their political ends.

The Texas Supreme Court are party hacks - especially Devine, that guy is particularly unscrupulous in his hack opinions - but this could turn out bad for Abbott. (FN: if the court was 100% dem in a crazy dem environment, they would likely be hacks as well). He's grabbing a **** ton of power under the disaster act with his dictatorial edicts. True conservatives would be against ruling in favor of such dictatorial powers. There's friction there. It's a question of whether principles or party politics prevail.

We disagree on almost everything, but I do agree with you here that Republicans have no spine in reigning in the massive overreach of power Abbott is using with the Disaster Act.

His failure to relinquish it will guarantee I will never vote for him again. And the excuse that the other guy will be worse doesn't hold water. We won't get better candidates if we keep voting in the less bad ones.

Edit to add that this has no bearing on whether mask mandates are legal or not, but the TSC per the law should rule in favor of Abbott and end the local tyranny of abusing children.

Seems to me all he is doing is restraining the powers that he has and has authorized the counties to use. The liberal hack judges and school boards are the ones fighting for more power.

It all depends on your perspective. To me it sounds like a bunch of liberals complaining that they can't tell other people what to do.

You're just blaming Abbott because your kid got the virus, and you think masks would have prevented it.
"If you will not fight for right when you can easily win without blood shed; if you will not fight when your victory is sure and not too costly; you may come to the moment when you will have to fight with all the odds against you and only a precarious chance of survival. There may even be a worse case. You may have to fight when there is no hope of victory, because it is better to perish than to live as slaves." - Sir Winston Churchill
