I hope they search for direction between elected officials on the left and Twitter/AWS During discovery and prove a violation of first amendment. I doubt they acted unilaterally.

Blame the judge all you want, but based on the allegations made in the lawsuit this tRO request was destined to fail from the start. As it currently stands, they won't get discovery on collusion because it hasn't really even been plead.

Democrats always use front groups like Media Matters to do this kind of work. They'll never tie it to a politician.

You can't really appeal the denial of a TRO request. From looking at the Order, they converted it to a preliminary injunction request so it can be appealed.

They may appeal, but will still lose. If you read the thread, its been explained why this demand to be put back online was doomed from the start. Parler admitted they had other options to host. That ended any chance they had at an "irreparable harm" finding.

Obviously, they were never going to be able to sue on "free speech" grounds but I think there's a serious argument for monopolistic practices and collusion in antitrust.
I really hope Parler wins this.

there may be a serious argument for monopolistic practices, but at this point Parler hasn't even attempt to make it. their complaint doesn't even mention any agreement by AWS and Twitter to do anything related to Parler.
AWS submitted sworn testimony there was no such collusion, Parler had no response. The judge had no real choice but to conclude there was not a substantial likelihood that Parler would succeed on the merits of that claim at this point

that may change as discovery takes place, but this ruling was easy for the judge.

If Parler had properly plead what they are asking for, they'd have a better chance of succeeding. They would still likely lose, but it wouldn't look like the trash filing it is now.

Update: Parler hated their own trash filing in federal court so much they decided to voluntarily dismiss it. They then doubled-down on their trash filing and refiled it in state court. To be fair, there are some issues here that are definitely state law claims, so at least they're in the correct jurisdiction this time. But I wouldn't hold my breath that they will go anywhere.

15 COAs and no request for injunctive relief.

Pretty good odds at least some of those COAs survive dismissal and we get delicious state court discovery, assuming Parler can prevent arbitration being compelled.

New attorney for Parler. They weren't satisficed with the guy that could not remember the CEO's name and admitted they had no real need for preliminary injunctive relief? Weird.
