Agree. Two Constitutional claims are always better than one.

I do have to note one thing however, by its own term, Bush v. Gore has no precedential value. But the point remains that the same rationale employed by the Court in that case is present in PA.

So then the question becomes, what is the remedy? Don't ask me because I truly don't know.

That's what I'm concerned about. I honestly don't think there is a majority on the court that would be willing to toss out a significant number of votes.

That's were Article II Section One might be applied. The state election officials are enjoined from certifying and then the PA state legislature is instructed to perform their duty in selecting the slate of electors? As long as it is done under the safe harbor provisions?

Maybe? People would scream but that seems to be the constitutional remedy in conjunction with federal statute.

Thomas, Gorsuch, Alito, Kavanaugh, and Coney-Barrett may jump on the chance to make a statement about election officials and state executive branch officials not having the ability to change legislatively passed election laws. They need to. All votes cast in violation of legislatively passed laws need to be tossed. The remedy may be drastic, but not doing this is more drastic, an illegally elected POS becomes President contrary to Constitutional mandate.

It's not necessarily throwing the votes out, just saying the vote can't be honestly certified. Now whether that is by county or state wide, I don't know. My focus was on the role of the state legislature to prevent the entire state from being disenfranchised in the EC. Article II Section says nothing about they have to act only before the election and if they approve a slate before the expiration of the safe harbor provision, does that become the remedy?

I fact checked before responding. From what I can tell FB does in fact list him as "Political Candidate" on his official page.

So where are we at currently with the EC votes due in a month?

I've seen several lawsuits fall flat. I did read the details on the PA ruling yesterday, but unclear how many votes that actually effects. Are we mostly waiting on the GA recount and "audit" in order to compare to the Dominion counts?

Trump and his campaign seem very confident in something...just curious if that something is actually known or he's just pandering to his supporters?

Are we sure that the lady taking the video isn't just someone standing back where they allow the media to stand? Because that's what it looks like.

I think she's trying to imply that she's supposed to be an approved "observer" and they are keeping her back behind the yellow tape, but it's hard to prove that without more information on who she is.
