I have now read that statute six times. Very poorly written but seems to me that the affirmative defense of self defense doesn't apply to unintentional homicide in the second degree. Which is kind of odd to me because if it is asserted in a first degree case, the burden shifts to the prosecution to prove beyond a reasonable doubt that the circumstances constituting such mitigation factors are not present. Yet the prosecution has no such burden of proof in the lower charge.Quote:

All that is required is the intent to kill and the death was not the result of Adequate provocation, unnecessary defense, prevention of a felony or coercion. At the very least this looks like a case of unnecessary defense (probably more likely justified self defense) so I'm not sure why they choose to go with 1st degree.

So, by charging intentional homicide in the first, the self defense case can be made. I don't think this DA really wants to bring this case.
