Texas is a "right to work" state. But what this means is that an
employee has a right
to not join a union. It does not mean that an
employer is immune from unionization, or has a right to violate the NLRA.
Portnoy's "threat" was all tongue-in-cheek and AOC fell for it, but if real, AOC would be partially correct in her response. An employee has rights under the NLRA to organize or act collectively with regard to terms and conditions of employment. You'd be amazed at how far this protection goes -- e.g. griping on social media about work conditions or hours. If employees at Barstool were truly engaging in organizing activity, a threat to fire anyone who participated would violate the law. AOC was right about that, but wrong about the procedure. The employees would file an unfair labor practice charge with the NLRB for retaliation or interference. There would be a variety of possible remedies, like backpay or damages, but the most costly one would be a forced union election or worse, forced recognition of a union.
So even though this is a joke and AOC is a dingbat and fell for it, be mindful of the bigger picture if you are an employer.
