My question...when were these newly produced handwritten notes actually written? Yesterday?

Sussmann is desperate and playing with fire. Cooper did Sussmann a favor by excluding certain evidence, but leaving the door cracked if the defense crossed the line, and this filing absolutely crosses it, by producing these mysterious handwritten notes that evidently the FBI/DOJ had no access to or Durham would already have them. The origin of these notes remain to be seen. The fact that McCabe is attached to them, is shady, and the fact that these notes are being represented as taken during official interviews makes them work product that somehow walked out of the FBI makes them evidence of a felony committed by them leaving the agency. McCabe has already lied under oath to the Senate that's well documented if he becomes a witness for the defense his impeachability for truthfulness is high. But if cooper allows these notes to be introduced to the jury, Katie bar the door on the mountain of crap Durham can bring.

There are two reasons why it could be compelled if Sussmann's defense intends to introduce anything related to McCabe either written or verbal without his testimony to back it up. Anything McCabe said or wrote shouldn't be admissible for materiality without his testimony. And my point being he's a highly impeachable witness based on his past lies under oath.

Oh I agree, that's why I said Sussmann's defense is acting out of desperation and playing with fire.

There's literally nothing these defense witnesses can say that doesn't help Durham build his conspiracy case. It's puzzling why they are taking this tactic

It depends on the context of the activity. Were they doing legal things or business things? Also, the description of the relationship are in third party notes that may be imprecise or presumptive.just saying..

Worried AGAIN as to what direction (conviction/acquittal) this thing is going!

Based on observations from the last several years...have already lost all respect for our Justice (?) System with little, if any trust in our courts. Example...IF E. Musk was threatened (reason for cryptic tweet last evening)...who does he turn to??? FBI - lol

Exactly. That's how I caught a bid rigging case back in my younger years of practice. City engineer calculated concrete costs in square feet instead of cubic feet. The "winning" bidder did the same. Oops!
