Exactly, my guess is Ratcliffe Patel already got them to him, but as you said, admissibility is a question based on how they were acquired and the privilege argument has to be resolved first. Every government contract has a contracting officer (KO) and almost always a designated Contracting Officer's Representative (COR). If the statement of work for the ONA contract with Halper or the DARPA contract with GTRI were broad and vague in their language then the contract COR would have provided the specific directions. Nobody except the KO or the COR can direct the actions of a contractor if they are not explicitly spelled out in the Statement of Work (SOW) or Performance Work Statement (PWS).
