First of all, a judge can deny a motion, correct?

If so, the definition of "in limine" seems to be getting a tad stretched here. However, if it's necessary to rebut each motion in limine, then I can't imagine why the prosecutors wouldn't be allowed to do their job. Sussman's team are the ones who brought it up!

For criminal trials, motions in limine nearly always are questions on the admissibility of certain pieces of evidence.

To me, that was a great write-up. I hate hearing any lefty attorney having a "near flawless performance@.

But I'm also hoping there will be a LOT more indictments before Sussman's trial. I'll remember Sussman's attorney-Bosworth.

I am still fascinated by the whole idea of Clinton claiming privilege over interactions that she was not a party to. Doesn't it torpedo or at least severely undermine all of Sussman's claims that he was not working for her when he went to the FBI if she is asserting privilege over the interactions with Joffe that led to him going to the FBI?

I'm not the guy you want to hear from, but it's a very good point.

In my mind, Sussman's attorney would use this defense any way, but he knows the judge, and knows certain judges are more interested in outcomes, rather than adjudicated law, so what the hell.

As usual, I hope I'm wrong about the judge. Let's put it this way, if K. Brown were the judge, I'd be VERY nervous.
