Durham’s materiality conundrum results from his decision to tip toe around the issue of whether the white paper and DNS data Sussmann gave to the FBI were false and misleading. The indictment hints that they were, but doesn’t outright allege it. Which opened the door for Sussmann

Sussmann’s attorneys told the judge they intend to ask the court to limit Durham’s evidence to what he alleged in the indictment. Typically the indictment doesn’t limit the prosecutor that way, but the argument here is that since the indictment was so broad snd far reaching,

If the jury were to hear evidence that one issue the FBI might explore would be whether Hillary was behind a corrupt plot to mislead the FBI, there would be no way any reasonable jury could decide the lie to hide Hillary’s involvement wasn’t material. But Durham won’t go there.
