Sullivan needs to be ignored to the highest degree. Worst thing you can do to a Prima Donna.
Sullivan can deny the MTD and sentence Flynn as he so desires. That having been said, actually getting Flynn into jail would be problematical with DOJ refusing to do so, but the conviction would be on his record.

The one thing no lawyer worth their salt should ever do is stand up a federal judge and leave them to their own devices because the risk to forfeit any appeal for lack of a record being made is very, very real. In legal terms it is called "preserving the error" because if you don't it is deemed waived as a matter of appellate law and not reviewable on appeal.

Boycotting hearings in any court is never a wise choice. Consequences could be too great. With a BSC OOC judge like Sullivan? Be like buying a ticket on the Hindenburg knowing it will blow up.

I'm beginning to think we should let Robert Hanssen out of jail. Since it took these jackwagons so long to catch that *******, apparently we have several folks who studied the techniques.

I wonder if Wray would give up Hanssen's information to Congress?

When I first got out of law school, I was shocked how political district court judges were. Didn't matter if all evidence and laws were on your side, if your opponent was representing the mayor's son, you were bound to lose.
Of course, you would win on the appellate level, and mayor's son could say, "District Judge took care of me but I was screwed by court of appeals. District Judge knew this and this was his way of securing support for his re-election.
I always found Federal court a more level playing field. But, apparently that has changed.

It has from my non-practicing experiences. When I was in federal court, I was not taking a single word the judge said as friendly advice. Eventhough I knew the judges in social settings.

So many federal judges are now disregarding the law, it is mind boggling.

As I observe in today's column, the worst part of the Circuit's decision (for the justice system, not for Flynn) is its indulgence of amicus curiae participation in criminal cases. The practice, for good reasons, has been exceedingly rare and discouraged including by Judge Sullivan, throughout his career and in the Flynn case . . . right up until he decided that appointing amici would be an effective way to resist the Justice Department's dismissal.

And now we see the wages of the Circuit's decision to accept rather than crack down on this practice. Sullivan orders the parties to include in their status report a proposed briefing schedule. The Justice Department and Flynn must come up with deadlines to file further replies to any other briefs that have already been submitted. Plus, not only DOJ and Flynn but Sullivan's specially appointed amicus adviser, former federal judge John Gleeson, must figure out a time to respond "to any amicus brief of non-Court-appointed amicus curiae."
Indulge me for a second. I give my takes mostly off of the cuff. Read the decision and make my conclusions. Been out of the biz for quite awhile now.

So when very respected legal analysts echo some of my points made here, Have to a do victory dance.

Mifsud was a spook but for Western Intelligence. Christ! He trained FBI,CIA and European intel agents for years. Mueller just refused to answer any questions about it.

I think it is becoming more clear that the special counsel's office was a criminal conspiracy in its entirety. These aren't a whole bunch of coincidental mistakes or oversights or errors that ALL benefit one side, and many of them are clearly deliberate. This needs to be rooted out in its entirety, but do many casual co-conspirators that failed to stop it or casually aided it are still in place.

Reading through Mifsud's 302, very little of it lines up with the time line. He's being interviewed in February 2017 but says he met Papadop "about 8 months" before. That would be June or late May 2016. Then he says about two months later he saw Papadop again, which would be July or August 2016. Finally he says he was in email communication with Papadop in December 2016 and says Papadop told him he was leaving the Trump campaign.

Then in his follow-up email to the FBI he does not narrow down or correct his earlier representations as ato any dates after reviewing his emails and notes?

This really doesn't look like a push/pull op to me, or if it was, Mifsud failed miserably on his end. Mueller just fabricated a lot of narrative to get to a desired conclusion.

My favorite part of the entire Jordan / Mueller examination comes at the 2:15 mark.

The FBI launches the investigation based on Papadopolous' statement to Misfud that the Russians have dirt on Hillary Clinton.

Jordan's question: How did Papadopolous find that out?
Mueller: I'm not gonna get in to the evidentiary filings...
Jordan: Well you told us. It's in your report. On p. 192.
Mueller: (Reaches for his copy of the report)
Jordan: Misfud told him.

You don't need a behavioral scientist to interpret his body language in that moment. The thought bubble over Mueller's head as his eyebrows dart upward says everything. "D'Oh."
