I understand that. And did not suggest he would be automatically disqualified because of it but do think the confirmation hearings would be rougher due to his lack of a legal or law enforcement background.
I guess I should have clarified. Make him acting, just like DNI. Move him to the hot spots to clean things up. There'd be no more "it embarrasses the FBI" redactions.
Two things. Appointments as "Acting" are time limited to 270 days, first off.
Second, there is a succession scheme that applies to DOJ and by extension to the FBI in the event of a vacancy. When Wray is fired, they will promote from within for the Acting Director pending Trump's nomination and confirmation of a successor Director.
Granted, there was supposed to be a succession plan in the ODNI, too but that position isn't as high profile as Director of the FBI and I think Barr might balk at that.
So I am back to the issue of whether he could be confirmed without a legal or law enforcement background.
