Then can you be guilty of tampering with an election that is not even scheduled and has no participants?

It seems to me the entire thing falls flat on its face on that alone. The most Trump can be accused of trying to tamper with is the Dem nomination process, and while that is not a good look (if you assume guilt - which I don't), that is a private process conducted by a private entity, the DNC.

It seems to me to be not dissimilar to Trump trying to influence the College Football Playoff Selection Committee to select or not select a given team.

Check the dates. Immediately following Zelensky's election. The only question I have is whether Zelensky is friendly enough with this oligarch to aid him in getting this bank back from the nationalization order. (Which may have been illegal but not sure the Ukrainian high court has ruled so don't quote me on that.)

If I am following this correctly, this was one of the banks wherein that 1 billion in loans was deposited and then a lot of it "disappeared." Through a Cypriot bank perhaps? Latvian bank? And then to Hunter Biden's accounts in the US?

Quote:

Secretary of State Mike Pompeo said Tuesday that five current and former State Department officials would not show up for depositions scheduled by House Democrats in connection with their impeachment inquiry.

Pompeo asserted that the committee's demand for testimony from five current and former State Department officials beginning this week raised "significant legal and procedural concerns" and questioned the committee's authority to compel an appearance by officials for a deposition through the letters sent last week, according to a letter that the secretary of State released on his Twitter feed.

"Based on the profound legal and procedural deficiencies the Committee's requested dates for depositions are not feasible," Pompeo wrote, adding that the State Department "will be in further contact with the committee in the near future as we obtain further clarity on these matters."

HA. If documents or testimony is withheld we will just make that evidence complimentary to our case.

People forget that Pompeo graduated first in his class at Harvard Law. He's no dummy. The House committees can shuck and jive all they want but he will just ignore them until (more if) they are on solid legal grounds.

When did the House vote to have an impeachment inquiry? Without a floor vote, no such thing exists to be obstructed.

Minor detail. Unfortunately that is a minor detail that the courts actually pay attention to when it comes to grand jury material from the Mueller probe.

Quote:

A judge told federal prosecutors on Monday that they needed to charge former acting FBI Director Andrew McCabe or stop investigating whether he lied to authorities.

Judge Reggie B. Walton said at a hearing that if prosecutors don't make a decision by Nov. 15, he would order the Justice Department to release internal FBI documents connected to McCabe's ouster, according to a transcript of the hearing.

"If the government has not made a call I'm going to make a ruling," he said. "This is just dragging too long. And those who have to make these hard decisions need to do it. And if they don't, I'm going to start ordering the release of information."

"I will not condone further delay," added Walton, a George W. Bush appointee who once presided over the Foreign Intelligence Surveillance Court.

WTF. Is there some double secret statute of limitations in effect that stops investigations at the whim of sympathetic judges?

Judges don't get to decide when investigations are conducted. They get to decide actions in their courts, right?

If he hasn't been charged, this isn't even at a court yet.

The comments came after Department of Justice (DOJ) lawyers spoke to Walton about the Freedom of Information Act (FOIA) lawsuit for documents on the FBI's probe of McCabe, according to The Washington Post. The government has reportedly said it would not release the documents due to their potential effect on law enforcement actions.

The FOIA suit was brought by the group Citizens for Responsibility and Ethics in Washington (CREW), in July 2018, the newspaper reported.

The group filed the request after McCabe was fired in March 2018.
CREW lawyer Anne Weismann sad during the hearing that the delays look like a "mad effort to find some way to indict Mr. McCabe to appease the president."

"We're in dark times where there's growing evidence that the president aided by the attorney general is using the power of his office to go after perceived political enemies. He's going after the intelligence community. He's going after the law enforcement community," Weismann said.

"I totally appreciate what you just said and share many of the same concerns," Walton responded.
Whoa! Quite unusual for a judge to be that blunt in a FOIA case! Those easily run for years and this one is barely a year old.

Quite the opposite. He is dictating prosecutorial decisions to DOJ within the context of a FOIA case.

Questionable, if not outright improper.

When I first read the title, I assumed this was part of a discovery fight in McCabe's civil suit for wrongful termination. More understandable, if still quite harsh within that setting.

But a FOIA case? Not even in the same ball park.

https://www.thedailybeast.com/barr-went-to-rome-to-hear-a-secret-tape-from-joseph-mifsud-the-professor-who-helped-ignite-the-russia-probe

Quote:

When Attorney General William Barr showed up at the U.S. embassy's Palazzo Margherita on Rome's tony Via Veneto last week, he had two primary requests. He needed a conference room to meet high level Italian security agents where he could be sure no one was listening in. And he needed an extra chair for U.S. Attorney John Durham of Connecticut who would be sitting at his right hand side.

Barr was in Rome on an under-the-radar mission that was only planned a few days in advance. An official with the embassy confirmed to The Daily Beast that they had to scramble to accommodate Barr's sudden arrival. He had been in Italy before, but not with such a clear motive. Barr and Durham are looking into the events that led to Robert Mueller's Russia investigation, and suddenly all roads were leading to Rome.

The Daily Beast has learned that Barr and Durham were especially interested in what the Italian secret service knew about Joseph Mifsud, the erstwhile professor from Malta who had allegedly promised then candidate Donald Trump's campaign aide George Papadopoulos he could deliver Russian "dirt" on Hillary Clinton. The Italian Justice Ministry public records show that Mifsud had applied for police protection in Italy after disappearing from Link University where he worked and, in doing so, had given a taped deposition to explain just why people might want to harm him.

A source in the Italian Ministry of Justice, speaking on the condition of anonymity, told The Daily Beast that Barr and Durham were played the tape. A second source within the Italian government also confirmed to The Daily Beast that Barr and Durham were shown other evidence the Italians had on Mifsud......

So Durham accompanied Barr to Rome, & the purpose of the trip was to acquire info on Mifsud.

Question for you attorneys (and this is off Ukrainian Banks topic) concerning declassification of documents. What keeps Trump from getting transcripts from the phone calls between Obama and the Ukrainian President in 2016 and tweeting them out? Why wait on alphabet agencies to comply with requests?

This isn't quite accurate as Barr & Durham were in Italy last week, but Pompeo's visit cannot be a coincidence. Remember, the US State Department was deeply involved in SpyGate, & Michael Gaeta, the FBI agent in Rome who was Steele's presumed handler, was actually the assistant legal attache at the US Embassy in Rome...he may still be for all that matter, & if so, perhaps Barr & Durham paid him a visit too.

Quote:

The State Department's inspector general is expected to give an "urgent" briefing to staffers from several House and Senate committees on Wednesday afternoon about documents obtained from the department's Office of the Legal Adviser related to the State Department and Ukraine, sources familiar with the planned briefing told ABC News.

Details of the briefing, requested by Steve Linick, the inspector general at State, remain unknown. Linick is expected to meet with congressional staff in a secure location on Capitol Hill.
Quote:

The unusual nature and timing of the briefing during a congressional recess suggests it may be connected to a recent intelligence community whistleblower allegation which describes, in part, the State Department's role in coordinating interactions between Rudy Giuliani, the president's personal attorney, and Ukrainian officials.
Quote:

The State Department's press office and the State Department's inspector general's office did not immediately respond to requests for comment. The committees expected to be part of the briefing did not immediately respond to requests for comment.

Told them not to hire legal counsel? Or else what? I briefly caught Pompeo saying something about House Dems declaring that State Department counsel was to be excluded from any interviews of current or past State Department employees (which is bad in and of itself) but I didn't hear anything about personal counsel being excluded. That's a violation of their 5th Amendment rights.
