Good read. Lays out how Rosenstein authorized Mueller to go after Flynn Jr. in his October memo (Rosenstein's third memo), & consequently Gen. Flynn plead guilty a month later. I hope Sidney Powell's quest for classified documents includes Rosenstein's scope memos to Mueller.

IIRC, Brady violations are considered some of the worst violations a lawyer can engage in.

Good questions. Generally speaking, the lawyer signing false pleadings or deliberately misleading the court are the specific targets of the judge's ire. So unless it is the same attorney involved in both cases, that would be a no.

As to RICO, unlikely it comes into play here because there was not a true criminal enterprise as motive for the acts done. Better addressed under conspiracy statutes, IMO.

My understanding is that the US can't increase the charges against Assange on the current extradition proceedings. The time for that has passed. Not sure if they wanted to charge him with more counts that they couldn't start a whole new extradition proceeding though. Extradition varies from country to country.

They can always dangle immunity with a Queen for a Day if the British authorities allow it while Assange is in lock -up.

Agree, when the FARA charge was thrown out of court before trial that took the wind out of the prosecution's sails. The guy is pretty scummy and treated his law partners in an abominable manner but the presence of the attorney client privilege muddied the waters enough to raise reasonable doubt.

FARA is actually a very complicated law wherein even experts on it can disagree what does and does not constitute a violation. Performing actual legal work, which Craig did in reviewing the entire Tymoschenko trial in depth, does not fall under the standard concept of "lobbying the US government."

And indeed, even talking to a reporter about the results of that legal review brings up First Amendment questions.

There is a reason FARA has seldom been prosecuted. It's a deeply flawed law.

There isn't much, if any, case law as it has seldom been successfully prosecuted as a crime and then been reviewed on appeal. It has mostly been handled as an administrative fine for the last several decades.

But since the statute is still on the books, people hire attorneys saying they are experts in the field of required government disclosures to advise them on which statute with which and how they need to comply.

That's what happened in the Flynn case. Covington, Burling law firm was hired to review the Inovo contract and advise them as to which disclosure statutes they needed to file a compliance form. That law firm did not advise that FARA was one of them. Flynn writes (or allows to be published under his name and op-ed about Turkey and WHOOSH! the feds sweep in under FARA.
