It's only Monday I'm waiting on Friday the 29th Judge Ellis' Court EDVA
What's on the docket on the 29th?
Flynn trial continuance that the Mueller team requested. Curious to his take on the camera viewed documents
Flynn's case is in Judge Sullivan's court, not Ellis.
You are correct too many venues to keep up
Update your spreadsheet. LOL.
I'm hoping Sullivan does the same as he did with Stevens and goes after Weissmann and Mueller both for cooking the books.

Remember the Warner-Waldman text messages? Someone else's name also appeared in them, someone about whom we later found out more information: former Feinstein staffer by the name of Dan Jones, who now heads the Penn Quarter Group which was funded to the tune of $50 million to dig up more dirt on Trump + other 'charitable' endeavors. No doubt that Warner is privy to some of the nefarious details of the plotters. If Mueller was conducting an above board investigation, Warner would someone to interrogate.

I'm betting Warner got a very harsh phone call from Mueller and likely was advised to keep Mueller's name out of his cock holster and if he knows what's good for him will stay away from his case that is teetering of falling completely apart as it is, and doesn't need the blowback of a drunk pole smoker bumping his gums out of turn.

Another way Rosey can mess with Strzok is to send him a target letter. If Strzok is advised he's under a grand jury investigation, he'll almost have to take the 5th.

On the other hand, if they lose the discovery battle, they will be faced with a bitter choice. Either disclose the purported classified secrets and go to trial or protect the secrets by dropping the charges against Concord. Option A would result in a meaningless "victory." Option B would be a major embarrassment and further proof that they are wasting their time and millions of our tax dollars trying to undo the outcome of the 2016 presidential election.

Either way, it couldn't happen to a nicer bunch of thugs.
From the moment that POS indictment was filed I knew this was inevitable if someone wanted to fight it in court. Reason #5342 that counter-intel investigations should only be criminalized in espionage and terrorism cases.

A five hundred thousand dollar fine that they couldn't collect even if they somehow won the case.

And let's be very generous for a moment and assume the parties charged were engaging in nefarious acts. Would telling them that we know about it so they could change their methods really the best course of action? Or should that information have been used to defeat their efforts and harden the targets to their attacks?

What would have been better for national security? Sheesh! A bunch of glory hounds without an ounce of foresight.

Do we know what his lie was to the FBI? What did they tell him to get the interview? My gut says they got the interview under false pretenses, but would be happy to be wrong.

Edit - I Googled his indictment and read it. His lie was that he said he met "the professor" and "a certain female Russian national" before he joined the Trump campaign. He became part of the campaign in "early March" and met "the professor" on March 14th and the female about March 24th. Interestingly, the indictment says:
Quote:

Through his false statements and omissions, defendant PAPADOPOULOS impeded the FBI 's ongoing investigation into the existence of any links or coordination between individuals associated with the Campaign and the Russian government' s efforts to interfere with the 2016 presidential election.

How the hell could being wrong about those dates impede the investigation in any way? Also interesting that "the professor" was reaching out to the Trump campaign that early. Isn't this even before the Comey meeting with Lynch about the "troublesome" new members of Trump's team?

2nd Edit - he gave them a crap ton of information. There's no way giving the wrong dates was intended to impede the investigation. The indictment cites the Washington Post as publishing on March 21st that he was part of the team. Seems to me that is after March 14th. This kid is getting screwed by team Mueller.

A 50 page dissertation + attachments on why Mueller's appointment is illegal, etc., and why charges should be dismissed against Concord Management. Seems Judge Ellis in Manafort's motion might want to peruse this treatise.

Edit: It would be neat if Ellis & Judge Friedrich both concluded that Mueller's appointment was illegal. The Deep State/Dems would never recover.

Yeah it's not like he lied about having knowledge of a secret illegal server or destroying emails or mishandling TS/SAP materials, or any petty crap like that. He missed the dates on a couple of meeting by a couple of weeks. Strap his ass in the chair and hook up the jumper cables.

The lawmakers say they are "disturbed" by the initial appointments to the probe of agents and attorneys with an anti-Trump bias. Their letter specifically references agent Peter Strzok, attorney Lisa Page and attorney Kevin Clinesmith.

"We know that these biases were shared among multiple people at the FBI and could be easily uncovered by Mr. Mueller with simple vetting," the letter says. "These individuals should not have been given an opportunity to influence directly or indirectly this special counsel investigation."

The letter also adds that the lawmakers are concerned that "there may be more politically biased investigators" working on Mueller's team.

For the Tl;dr crowd: The swamp was unconstitutionally swampy in the appointment of Mueller so the indictment should be dismissed.

I understand Flynn folding to protect family but no real American would ever fold on that charge unless they were in on it. I would have demanded to go immediately to trial if all they had were some wrong dates. Seems more than likely Pap was an informant.

Well, I did read it. And they made some very good points. (As an aside, it is refreshing to see how excellent lawyers actually structure and compose pleadings as opposed to the hot messes Team Mueller has promulgated.)

We'll see if Team Mueller actually responds to this or punts it to Jessie Liu's US Attorneys.

I read it before I posted. I think my tl;dr is pretty close. I'll edit my post to reflect "for the tl;dr crowd".

I also thought it was well done. Arguments by Mueller to defend one point are likely to hurt him on a different point.

DING! DING! DING!

When Papadop was arrested at the airport, he was very upset. The FBI called his lawyers (because they already were working with him and knew whom to call) to calm him down. There was obviously an arrangement that Papadop was completely different than what he was led to believe it was.

Yeah, a Catch 22. He can't defend both sides of inapposite positions. I also like their use of the Manafort's lawyers' efforts in Judge Ellis' court. They also gave a more grounded and expanded context for the arguments about the Appointments Clause.

Think about what Sessions did in bringing in Huber, already an US Attorney, and Rosenstein appointing a private attorney with no mandatory nor effective supervision. The arguments they presented were statutory construction at its most maddening but quite correct in conclusions. Lawyers live for the differences between mandatory and precatory language. (The latter is defined as "wishful" language for the IANALs.)

The problem with Paap being an informant is how does an informant get a conviction for lying about contacts with another informant? He was looking at a huge legal bill for a trial and he did "technically" lie. Easy to see entering a plea to avoid costs and uncertainly, considering he didn't know "the professor" was an informant and the "female Russian national" was a plant of some sort (she was certainly recruited by "the professor"). Would have to expect a different decision knowing what we know now.

His lawyer was with him in his second interview with the FBI in February of 2017. While it certainly seems he was misled about what his agreement was, informant doesn't make sense. What is the point of getting a conviction from an informant for lies about contacts with other informants?

Reading his indictment with the hindsight of knowing "the professor" was an informant and the "female Russian national" was working with "the professor" really makes my blood boil that this kid is having this done to him. I hope the karma of this bites the perpetrators in the ass hard.
