Comey is going to lose on that motion to quash. Court cannot order the method in which the House and Senate conduct their Constitutionally mandated oversight duties. Their subpoena, their rules. Separation of powers issues.

(That isn't to say some idiot DC federal District Court judge won't grant it. Won't get too far on appeal, though.)

All he has to do is run out the clock until January and then we know nothing will happen except tons of REEEEEEEEEEEEEEEEEEEEEEEE! from the House Democrats.

.....His attorneys argue the subpoena request violates House rules, which they assert operate under the presumption that hearings be open to the public.

Comey's legal team also argues that the House committees have selectively leaked details of closed-door testimony from other current and former FBI officials.

.....Comey's concerns about leaks are likely to receive little sympathy considering his own role in leaking memos from his FBI days to a personal friend, Daniel Richman......

FBI has been hitting doors pretty good lately, wonder if this is good news for Hillary Clinton

  • The FBI raided the home of a whistleblower who was in possession of documents regarding the Clinton Foundation and Uranium One, according to the whistleblower's lawyer, Michael Socarras.
  • The whistleblower, Dennis Nathan Cain, had turned the documents over to the Department of Justice's inspector general and both the House and Senate Intelligence committees, according to the lawyer.
  • The FBI rummaged through Cain's home for six hours, even after the whistleblower handed over the documents, according to Socarras.

Quote:

FBI agents raided the home of a recognized Department of Justice whistleblower who privately delivered documents pertaining to the Clinton Foundation and Uranium One to a government watchdog, according to the whistleblower's attorney.

The Justice Department's inspector general was informed that the documents show that federal officials failed to investigate potential criminal activity regarding former Secretary of State Hillary Clinton, the Clinton Foundation and Rosatom, the Russian company that purchased Uranium One, a document reviewed by The Daily Caller News Foundation alleges.

The delivered documents also show that then-FBI Director Robert Mueller failed to investigate allegations of criminal misconduct pertaining to Rosatom and to other Russian government entities attached to Uranium One, the document reviewed by TheDCNF alleges. Mueller is now the special counsel investigating whether the Trump campaign colluded with Russia during the 2016 election.

"The bureau raided my client to seize what he legally gave Congress about the Clinton Foundation and Uranium One," the whistleblower's lawyer, Michael Socarras, told TheDCNF, noting that he considered the FBI's raid to be an "outrageous disregard" of whistleblower protections.

Sixteen agents arrived at the home of Dennis Nathan Cain, a former FBI contractor, on the morning of Nov. 19 and raided his Union Bridge, Maryland, home, Socarras told TheDCNF.

The raid was permitted by a court order signed on Nov. 15 by federal magistrate Stephanie A. Gallagher in the U.S. District Court for Baltimore and obtained by TheDCNF.

A special agent from the FBI's Baltimore division, who led the raid, charged that Cain possessed stolen federal property and demanded entry to his private residence, Socarras told TheDCNF.

"On Nov. 19, the FBI conducted court authorized law enforcement activity in the Union Bridge, Maryland area," bureau spokesman Dave Fitz told TheDCNF. "At this time, we have no further comment."

Cain informed the agent while he was still at the door that he was a recognized protected whistleblower under the Intelligence Community Whistleblower Protection Act and that Justice Department Inspector General Michael Horowitz recognized his whistleblower status, according to Socarras.

If you go to the Website for the FBI's Baltimore Field office:

The Special Agent in charge is Gordon B. Johnson:

Several months ago I posted the thread below:

https://threadreaderapp.com/thread/1037358656138792967.html

There are several references to Gordon Johnson in this thread, including the most important:

Gordon Johnson is mentioned at least 3 times in the Strzok-Page texts. He would have worked with Priestap. He was there from December 2015 till August 2016.

I am not suggesting something nefarious regarding this raid -- whistleblowers copy stuff to thumb drives, & since it's stolen government property, the government needs to make certain that all of it has been recovered -- but Gordon Johnson has definite links to players in SpyGate.

Has Mueller Subpoenaed the President?

Quote:

As we expected, he has gone quiet in deference to long-standing Justice Department policy that prosecutors should not take actions that might impact pending elections. Whatever he is doing, he is doing quietly and even farther from the public eye than usual.

...

...we may have stumbled upon How Bob Mueller Is Spending His Mid-Terms: secretly litigating against President Trump for the right to throw him in the grand jury.

...

But now, thanks to Politico's reporting (backed up by the simple gumshoe move of sitting in the clerk's office waiting to see who walks in and requests what file), we may know what Mueller has been up to: Since mid-August, he may have been locked in proceedings with Trump and his lawyers over a grand jury subpoenain secret litigation that could tell us by December whether the president will testify before Mueller's grand jury.

...on August 16th (the day after Giuliani said he was almost finished with his memorandum, remember), a sealed grand jury case was initiated in the D.C. federal district court before Chief Judge Beryl A. Howell. We know that on September 19, Chief Judge Howell issued a ruling and 5 days later one of the parties appealed to the D.C. Circuit. And thanks to Politico's reporting, we know that the special counsel's office is involved (because the reporter overheard a conversation in the clerk's office). We can further deduce that the special counsel prevailed in the district court below, and that the presumptive grand jury witness has frantically appealed that order and sought special treatment from the judges of the D.C. Circuit...
Quote:

  • The parties and the judges have moved with unusual alacrity. Parties normally have 30 days to appeal a lower court action. The witness here appealed just five days after losing in the district courtand three days later filed a motion before the appellate court to stay the district court's order. That's fast.
  • The appeals court itself responded with remarkable speed, too. One day after getting the witness's motion, the court gave the special counsel just three days to respondblindingly short as appellate proceedings go. The special counsel's papers were filed October 1.
  • At this point an unspecified procedural flaw seems to have emerged, and on October 3, the appeals court dismissed the appeal. Just two days later, the lower court judge cured the flaw, the witness re-appealed, and by October 10 the witness was once again before appellate court. Thanks to very quick action of all the judges, less than one week was lost due to a flaw that, in other cases, could have taken weeks or months to resolve.
  • Back before the D.C. Circuit, this case's very special handling continued. On October 10, the day the case returned to the court, the parties filed a motion for expedited handling, and within two days, the judges had granted their motion and set an accelerated briefing schedule. The witness was given just 11 days to file briefs; the special counsel (presumably) just two weeks to respond; and reply papers one week later, on November 14 (for those paying attention, that's 8 days after the midterm elections). Oral arguments are set for December 14.

Quote:

But is it the president? The docket sheets give one finalbut compellingclue. When the witness lost the first time in the circuit court (before the quick round-trip to the district court), he unusually petitioned for rehearing en bancmeaning he thought his case was so important that it merited the very unusual action of convening all 10 of the D.C. Circuit judges to review the order. That is itself telling (this witness believes his case demands very special handling), but the order disposing of the petition is even more telling: President Trump's sole appointee to that court, Gregory Katsas, recused himself.

I don't think its a subpoena of Trump, but the appeal is being heard in a closed session 12/14.

Without even bothering to cite controlling adverse authority or follow the most basic procedural requirements for initiating a new civil action, Mr. Comey brazenly demands that this Court issue an order quashing a congressional subpoena directed to him a request for relief so extraordinary and frivolous that, as far as undersigned counsel is aware, no district court in the history of the Republic has ever granted such a request. Although one would not know it from reading Mr. Comey's papers, the Supreme Court has spoken unequivocally on this question: "the Speech or Debate Clause provides complete immunity for issuance of this subpoena." Eastland v. U. S. Servicemen's Fund, 421 U.S. 491, 507 (1975). Mr. Comey cannot evade the Supreme Court's squarely controlling precedent by failing to cite it.

Admitting that there's virtually no case law supporting his motion to quash, Comey attorney basically told Judge McFadden, "Here's your opportunity, judge, to make some law."

Glenn Simpson tried the same move with the same court and was shot down, he just walked in and pled the 5th after that.

The big Malaysian case that resulted in guilty pleas that is linked to Obama/Clinton Fundraisers & Goldman Sachs perhaps? Webb has been camped out in front of the courthouse watching all those coming and going. Webb is actually right a lot, but he hits you with such a deluge of information and theory constantly and rambles off on unexplainable tangents he's hard to keep up with. He was way ahead of the curve on the Awan's and no one paid him any attention.

He made some good points about Cooper on one of his streams, and explained where the DOJ may have leverage on Cooper. The internet domain, clintonemail dot com, was registered to Cooper, not the Clintons, while she was secretary of state. The domain was registered by Cooper before Hillary became secretary of state on January 21, 2009. Hillary used the email exclusively on her private server while secretary of state, rather than use a dot gov account for all of her secretary of state work. Cooper had no US security clearance or any expertise in computer security. Cooper also helped the Clintons with other tech support. Cooper hired as a contractor, Bryan Pagliano, the former IT director for Clinton's 2008 presidential campaign, was hired to maintain their private email server while Clinton was secretary of state, however the domain was still registered to Cooper. In the summer of 2014, lawyers from the State Department noticed a number of emails from Clinton's personal account, while reviewing documents requested by the House Select Committee on Benghazi. When a request by the State Department for additional emails led to negotiations with her lawyers and advisors, almost immediately clintonemail dot com changed to a new registered owner, Perfect Privacy, a proxy company. However all the illegal activity and classified information being handled on the server was registered in Cooper's name and puts him possibly in deep deep water, and Webb's theory is they has squeezed him to flipping on the Clintons.

What's also problematic to me is as early as 2009, officials with the National Archives and Records Administration expressed concerns over possible violations of normal federal government record-keeping procedures at the State Department under then-Secretary Clinton. But that entire thing was covered up, and Barry playing ignorant claiming he heard about the server when it was exposed on the news like the rest of us is blatantly absurd.

Another is after being ordered under subpoena to handover her emails, Clinton lawyers delivered 12 file boxes filled with printed paper containing more than 30,000 emails. Clinton withheld almost 32,000 emails deemed to be of a personal nature, weddings and yoga so they said. Then later with the Weiner laptop discovery they found over 650,000 emails from that server. That's a huge difference than her claim of 62,000 +/- by a factor of over ten. And that's overlooked in all of this like no big deal. Anyway, who has those 650,000 emails now Hopefully Horowitz/Huber. Horowitz has been digging into the Clinton email crimes for almost 2 years. What was in Clinton's emails? Especially on the Weiner laptop, which likely contained many of the 33,000+ emails the witch was desperate to hide? Pay for play schemes? You bet there are. And what was the BIGGEST PAY FOR PLAY SCHEME OF THEM ALL? Uranium One. Everything else pales in comparison and is overshadowed by that Mt. Everest of national security breach.

ETA: If it is actually Justin Cooper, his attorney was Aaron Zelbey. Zelbey is an attorney on Mueller's team. Hmm interesting.

Newly filed court documents confirm that Fusion GPS, the company mostly responsible for the controversial "Trump dossier" on presidential candidate Donald Trump, made payments to three journalists between June 2016 until February 2017.

The revelation could be a breakthrough for House Republicans, who are exploring whether Fusion GPS used the dossier, which was later criticized for having inaccurate information on Trump, to feed anti-Trump stories to the press during and after the presidential campaign. The three journalists who were paid by Fusion GPS are known to have reported on "Russia issues relevant to [the committee's] investigation," the House Intelligence Committee said in a court filing.

But the recipients' names, the amounts, and purposes of those payments were either redacted from the documents that Fusion GPS filed to the U.S. District Court for the District of Columbia or were not disclosed.

Fusion has asked the court to issue a restraining order against the House committee, which is demanding documents from the company that, among other things, explain the payments it made to reporters. Most of the documents sought are banking records......

Seems like progress is very slow in these investigations.

Nadler and Maxine Waters incidentally, point out one of the real failures of the American Congressional system. One that "another go at it" should get rid of. In this case it is the Democratic Party having the issue, but it applies to all. This stupid idea that seniority alone or some other such standing entitles you to super important committee positions is very foolish. What if, as in the case of Maxine or SJL, you simply have a lock-step district voting you in over and over again, and it has nothing to do with ability?

Is it really true they have to get the positions "because it is their turn" or could the Speaker say "No way" ???
