All they happened is some doofus in the past wrote a note in the corner of each document what the the believed date of creation was.

Either they foolishly wrote on the originals, or they wrote on a copy and the copy with the added date was presented as an evidentiary document, which it was also, being government product itself.

Agree. FWIW, I think the latter. It was the second working copies that were attached and not the clean ones. It happens on occasion.

But who in their right mind begins taking notes and don't date them right off of the bat? Especially freakin' FBI agents?

That's probably because Weissman is pure scum and Sydney shined a big spotlight on him.

He ruined the lives of tens of thousands of people with his shenanigans. I'm flabbergasted he hasn't been disbarred already and had continued to work in DOJ for years even though he was eviscerated by SCOTUS 9-0.

Not sure I want my phone number to be known by calling in. Have you seen another method or link wherein I can hear the audio without having to call in? (Because I'd wager that system will crash at some point anyway beyond my privacy concerns.)

He kept his job probably because he was an unethical hatchet man. He was willing to do what it takes for his bosses without them having to dirty their own hands. They just had to put him in the right position and let him do his unethical underhanded thing.

Sullivan is lying about Flynn refusing to cooperate in the Rafekian case. He was willing to testify but not to what they wanted him to say because it wasn't the truth.

FTR: The judge threw out the case after the jury convicted Rafekian.

Not sure Sullivan really wants to go there. He's focusing on the DOJ's statement of reasons for the MTD (motion to dismiss). It seems he has forgotten that DOJ told the DC Circuit that the DOJ had other reasons in so moving above and beyond the ones stated.

Seriously? What a wanker!

I would think that having most of the people who matter at DOJ, IN THE COURTROOM, would make a modest impression.

I'm glad I won't be able to check on this for a couple of hours. Before I die, I'd love to know why Sullivan chose to become his own little fiefdom. This might even be enough for Eric Holder to blush, but since he's likely got his fingerprints on this, probably not.

So if Judge Sullivan dismisses the Motion to Dismiss, isn't he saying that the Judiciary holds all the power to continue on with the sentencing portion after the prosecutor has said they do not want to prosecute this case any longer?

Sullivan's position is that once the guilty plea is accepted by the court, sentencing is solely an Article III, that is a judiciary function not a prosecutorial decision.

Meaning Sullivan seems to be prepared to sentence Flynn anyway.
