I have given up trying to predict what Judge Sullivan will do with the motion to withdraw Flynn guilty plea

His previous counsel really screwed him over and Sullivan may deny it on that basis. IOW Flynn had his chance long ago and is now SOL.

It seems like early in the case one of you felt like Sullivan was in so many words basically asking him to withdraw the plea, but he didn't. I'm betting he won't let him withdraw it now.

Unfortunately I tend to agree. But I don't know how the judge who went off over the Ted Stevens case like he did can square that circle on an equitable basis.

Sure seems like he has a strong ineffective assistance of counsel claim.

He pleads guilty, he support other cases, that gets "he was a major help in other investigations". Since the government reneged on the last part, he can reneg on the pleading guilty part.

Well, seems Judge Sullivan's interest is at least a little piqued.

So we should know something in a month it looks like.

Powell said she needed more time to formulate the plan with the other reasons she is asking for him to rescind his guilty plea. Judge Sullivan is only giving her until the 22nd. So hopefully she had it mostly together, and can put forth a convincing motion.

Sort of but not quite, IMO. Granted, the government is not honoring the deal but they say Flynn breached it first. Fact question for the judge to decide. Hence the Minute Order setting a briefing schedule for alternative reasons to withdraw his plea.

My comment was more directed to earlier hearings when Sullivan appeared to be practically begging him to withdraw his plea, recessed to give him time to thoroughly consult with his attorneys at the time. From Sullivan's perspective, Flynn had his shot then.

Powell argues that the conflict of interest Burling, Covington had regarding the FARA issue was not the kind that could be waived by Flynn. Sullivan ruled against her on that point. So what I'mm seeing as the biggest question in Sullivan's mind is whether the prosecution breached the agreement or Flynn did.
